Frequently asked questions relating to the Paragon Mortgages Solicitor Panel

It has come to my attention via my mortgage adviser that my the law firm I have appointed is not on the Paragon Mortgages Conveyancing panel. How can I be sure that this is correct?
The best course of action for you to take is to contact your conveyancer. It is reasonable to expect your lawyer to advise you what has happened. If they are not on the panel they could put your in touch with solicitors on the the approved Paragon Mortgages solicitor panel.
My lawyer has spotted an inconsistency when comparing the surveyor’s assumptions in Paragon Mortgages’s valuation report and what is in the conveyancing documents. My lawyer says that as he is on the Paragon Mortgages conveyancing panel he is duty bound to ensure that the lender is OK with this discrepancy and is still content to lend. Is my conveyancer’s stance appropriate?
A precondition to being on the Paragon Mortgages approved panel is to comply with the CML Handbook requirements (last updated for this lender on Paragon Mortgages) which do require that your lawyer disclose any incorrect assumptions in the lender’s valuation report and the legal papers. Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for you.
Do all mortgage companies provide you with an approved list of solicitors? How do you know who is on the Paragon Mortgages conveyancing panel?
The law firm practices themselves provide us confirmation that they are on the Paragon Mortgages conveyancing panel as opposed to being supplied with a list from Paragon Mortgages directly.
My grandmother passed away last year and as sole heir and executor was left the property. The house had a small mortgage left on it of around £8000. I want to transfer the title deeds into my name whilst I re-mortgage to Paragon Mortgages , pay off the mortgage etc. Is this allowed?
If you intend to re-mortgage then Paragon Mortgages will insist on your using a conveyancer on the Paragon Mortgages conveyancing panel. Here is link to the Land Registry online guidance around what to do when a property owner dies. This will help you to understand the registration process behind changing the details re the registered title. in your case it would appear that you are effectively purchasing the property from the estate. Your Paragon Mortgages conveyancing panel solicitor pays the new mortgage money into the estate, the estate pays off the old mortgage, the charge is released and you become the owner and the Paragon Mortgages mortgage is registered as a charge at the Land Registry.
I have a mortgage with Paragon Mortgages. Conveyancing was finalised some time ago. If I am intending to rent out my property and do not currently have a buy-to-let mortgage do I need to remortgage to a buy-to-let mortgage or inform Paragon Mortgages?
You must advise Paragon Mortgages in advance of letting out your property as this is likely to be a breach of Paragon Mortgages’s mortgage conditions. It may be that Paragon Mortgages will allow you to rent out your former home without needing to switch to a buy-to-let mortgage but some lenders will add a surcharge to your mortgage rate to reflect the higher risk. You should contact Paragon Mortgages directly. You need not do this via a Paragon Mortgages conveyancing panel firm.
The for formalities of my remortgage has taken place with a mortgage from Paragon Mortgages. Conveyancing was of an acceptable standard but I feel I should register my dissatisfaction about Paragon Mortgages. How do I make a complaint?
Most lenders have complaints procedures. Your first port of call should be one of the Paragon Mortgages branches or the Customer Care Team at Paragon Mortgages head office. Ordinarily complaints to Paragon Mortgages are sorted out very quickly. However if you are not satisfied that the matter is resolved you can write to the Financial Ombudsman Service with full details of your complaint.
I have instructed a lawyer having made sure that they are on the Paragon Mortgages conveyancing panel. Does my lawyer arrange the survey of the property? Or I've digested plenty of house buying,I note that it is considered advisable to get your house surveyed prior to buying it. When I asked my solicitor - who is on the Paragon Mortgages conveyancing panel - on this she said they don't do this and I need to contract an independent surveyor. is that correct?
Paragon Mortgages will need an independent valuation of the property. Your lawyer will not arrange this. Usually Paragon Mortgages will appoint their own surveyor to do this, and you will have to pay for it. Remember that this is a valuation for mortgage purposes and not a survey. You may wish to consider appointing your own surveyor to carry out a survey or prepare a home buyers report on the property. It is up to you to satisfy yourself that the property is structurally sound before you buy it. If the survey or report reveals that building work is needed, you should tell your solicitor. You may wish to renegotiate with the seller. or Your lawyer will not organise the survey but they may be able to put you in touch with a local one that they recommend. RICS offers a find a surveyor service (just google it) where you can search for a qualified surveyor by postcode. As you are getting a mortgage with Paragon Mortgages you could contact your them to see if they have a list of approved surveyors.
