I am in the process of selling my flat and the EA has just e-mailed to warn that the buyers are appointing a new solicitor. The excuse is that Paragon Mortgages will only engage with property lawyers on their approved list. Why would a big named mortgage company only engage with certain law firms?
Banks have always had panels of law firms they are willing to work with, but in the past few years big names such as HSBC, have reviewed and reduced their conveyancing panel– in some cases removing conveyancing firms who have worked with them for more than 25 years.

Lenders point to the increase in fraud as the reason for the cull – criteria have been tightened and a smaller panel should be easier to keep an eye on. No lender will say how many solicitors have been dropped, claiming the information is commercially sensitive, but the Law Society says it is being contacted daily by practices that have been removed from panels, or have other concerns about them. Some do not even realise they have been dropped until contacted by a borrower who has instructed them as might be the situation in your buyer’s case. Your purchasers are unlikely to have any sway in the decision.

My conveyancer has discovered a discrepancy between the surveyor’s assumptions in Paragon Mortgages’s home valuation survey and what is in the title deeds. My lawyer informs me that as he is on the Paragon Mortgages conveyancing panel he needs to check that the bank is with this discrepancy and is still content to lend. Is my solicitor’s stance legitimate?
A precondition to being on the Paragon Mortgages approved panel is to comply with the CML Handbook requirements (last updated for this lender on Paragon Mortgages) which do require that your lawyer disclose any incorrect assumptions in the lender’s valuation report and the legal papers. Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for you.

The lawyers that I recently instructed on my house acquisition in Manchester has without warning closed. Assuming that you have an Estate Agent in the equation then let them know immediately so that they can let the sellers know that there may be a slight delay due to the problems encountered. Hopefully they will be sympathetic and urge their lawyer to send a new set of papers to your new solicitors. You will need to appoint new lawyers that are on the Paragon Mortgages conveyancing panel and notify the lender. If you have paid over any money it will hopefully be held by the SRA as money in an intervened firm's bank accounts is transferred to the SRA. Then, the SRA or the intervention agent looks at the intervened firm's accounts to work out who the money belongs to. To claim your money you will need to contact the SRA. If the SRA cannot return money you are owed from the firm's bank accounts, or if they can only return part of the money, you can apply to the Compensation Fund for a grant. Are all solicitor firms on the Paragon Mortgages conveyancing panel overseen by the Solicitors Regulatory Authority?
As a firm of solicitors, in order to be on the Paragon Mortgages conveyancing panel they would need to be regulated by the Solicitors Regulatory Authority. Many lenders do allow licenced conveyancers on their panel in which case such firms would be regulated by the Council of Licensed Conveyancers (CLC).
I have not been happy with the level or service received from my lawyer. Is there a Paragon Mortgages conveyancing panel complaints department or do I complain directly to the law firm?
There is little point in complaining directly to Paragon Mortgages. Every solicitor firm and conveyancer must have a complaints procedure. You can get information from the solicitor’s or conveyancer’s website or ask at their office. They must tell you about it if you ask.

The Legal Ombudsman will make sure that your complaint is addressed by the solicitor. It can also advise you how to complain.

My offer on house has been accepted, the seller does however have a dependent purchase. The vendors have offered on somewhere, but not been accepted yet, and have viewings of other properties in the pipeline. My conveyancing solicitor has been instructed. What do I do now? It is usual to have concerns where there is a chain as you are unlikely to want to be too out of pocket too early (mortgage application is approx £1k, then survey/valuation, conveyancing search costs, etc). First you should check that your solicitor is on the Paragon Mortgages conveyancing panel. As to the next stages this very much depends on the circumstances of your case, desire for this property and on the state of the market. In a hot mortgage some buyers would pally for the mortgage with Paragon Mortgages and pay for the valuation and only if it comes back ok would they pay their solicitor to press on with searches.
