I instructed a solicitor to conduct the legal paperwork on my remortgage 4 weeks ago having applied for a mortgage with Topaz Finance. The firm assured me that they are on Topaz Finance conveyancing panel and advised me their panel number. Topaz Finance then called me to say that their panel number was dormant and would need to be reactivated. What happens next? Do I instruct a different law firm currently on the approved panel for Topaz Finance?
You may be very frustrated with the lawyer but if it only go take a few more days they it may be worth waiting as, depending on how far progressed you are you may end up delaying the transaction by a number of weeks if you need to replace your solicitor You may wish to enlist the help of your broker to check with the Topaz Finance as to how long they think it will take to get the firm to get back on the panel.
My conveyancing solicitor has requested from me proof of ID documents stating that this is part of his legal duty as a solicitor on the Topaz Finance Conveyancing panel. Am I being spun a yarn?
Due to Money Laundering Regulations your conveyancing lawyer is duty bound to confirm positively your identification when entering into a business relationship with you. It is a criminal offense if your lawyer not do this. If you do not provide ID early in the transaction the solicitor must refuse to act for you. It’s unlikely a lawyer will turn you away if you come to the first meeting without relevant ID but you will have to produce it at some point so you might as well bring it with you to the initial meeting so the lawyer can tick the ID verification box and start sorting out the conveyancing straight away. If you are getting a mortgage with Topaz Finance your lawyer also has to check ID documents to satisfy Topaz Finance

The lawyers that I appointed last week on my house acquisition in Manchester has without warning closed. I chose them because I had to have a solicitor on the Topaz Finance conveyancing panel and my family lawyer was not. I gave them a cheque for £150 in advance. What should be my next steps?
Assuming that you have an Estate Agent in the equation then let them know straight away so that they advise the vendors that there may be a slight delay due to reasons beyond your control. Most sellers would be sympathetic and urge their lawyer to send a new set of papers to your new solicitors. You will need to appoint new lawyers that are on the Topaz Finance conveyancing panel and notify the lender. If you have paid over any money it will hopefully be held by the SRA as money in an intervened firm's bank accounts is transferred to the SRA. Then, the SRA or the intervention agent looks at the intervened firm's accounts to work out who the money belongs to. To claim your money you will need to contact the SRA. If the SRA cannot return money you are owed from the firm's bank accounts, or if they can only return part of the money, you can apply to the Compensation Fund for a grant. Your new solicitors should be in a position to help
I previously instructed online conveyancers based in Cardiff who are on the Topaz Finance solicitor panel. They are now charging me a separate fee of £150 for dealing with the Topaz Finance mortgage. Is this a supplemental conveyancing fee specified by Topaz Finance?
Unfortunately, as long as it is in their Terms and Conditions or Quote then yes your solicitors can charge a fee for this. This fee is not set by Topaz Finance but by your lawyers. Some firms on the Topaz Finance will charge an ‘acting for lender’ fee and others do not.
My wife and I have arranged a further advance on our mortgage from Topaz Finance as we wish to carry out alterations or improvements our home. Do we need to appoint a solicitor on the Topaz Finance conveyancing panel to deal with the legals?
Topaz Finance would not normally instruct a member of their approved list of lawyers to deal with such a matter. If they did require any legal work then you would need to ensure that such a lawyer was on the Topaz Finance panel
What are the common reasons for a lender such as Topaz Finance to withdraw a mortgage offer?
Banks and Building Societies such as Topaz Finance can withdraw their mortgage offer although this is unusual. If Topaz Finance withdraw their offer they may or may not inform you or the lawyer as to the reasons why. There are various possible reasons but here are a few examples:
- Topaz Finance may amend or withdraw an offer if the Topaz Finance conveyancing panel solicitor is unable to confirm compliance with any of the conditions of the mortgage offer or if any of the terms of the mortgage offer cannot be satisfied
- If the borrower informs Topaz Finance of a change in the loan amount agreed
- A cashback to the buyer, or | part of the price includes a non-cash incentive to the buyer (eg paid stamp duty land tax),or | any indirect incentive (cash or non cash) or rental guarantee, of which the lender was previously unaware
- Where the purchase price and borrowers direct contribution differ to details on the mortgage application form completed by the borrower
- Where the Lender’s right to possession is fettered in some way
