FAQs for the Capital Home Loans Conveyancing Panel

For what reasons would a law firm be removed from the Capital Home Loans approved conveyancing panel?
A survey recently commissioned by the Solicitors Regulatory Authority found that three quarters of law firms had been removed from a lender panel. The most common reasons in order are :
  1. lack of transactions
  2. the lawyer is a sole practitioner
  3. as part of the HSBC panel reduction
  4. regulatory contact by SRA
  5. accidental removal. We are not aware of the specific or common criteria for removal by Capital Home Loans
I am buying a newly constructed duplex and my lawyer is advising me that she has to disclose incentives from the seller as her practice is on the Capital Home Loans conveyancing panel. I am on a tight deadline to exchange contracts and my preference is not to prolong matters. Can I insist on an exchange regardless of what my lawyer says about being on the Capital Home Loans panel?
You should not exchange unless you have advised to do so by your lawyer. A precondition to being on the Capital Home Loans approved panel is to comply with the CML Handbook requirements (last updated for this lender on Capital Home Loans). The CML Conveyancing Handbook requires that your lawyer have the appropriate Disclosure of Incentive form completed by the developer and accepted by your lender.
Whilst your website is a good idea there are many lawyers listed near Chelsea on the Capital Home Loans conveyancing panel. Can you recommend a specific firm on the conveyancing panel for Capital Home Loans ?
We are not in the business of recommending one firm above another as the right firm for you depends on where your priorities lie. For example you may require a local firm with local knowledge or you might be looking for the low cost conveyancing. Before you appoint your lawyer we advise you to speak to two or three of the firms listed to gain comfort as to which one is right for you..
The solicitors that I recently instructed on my house acquisition in London has suddenly closed. They were on acting for me because I had to have a lawyer on the Capital Home Loans conveyancing panel and my previous lawyer was not. I paid them £200 on account. What should be my next steps?
Assuming that you have an Estate Agent in the equation then inform them straight away so that they advise the vendors that there may be a slight delay due to the problems encountered. Hopefully they will be sympathetic and urge their lawyer to send a new set of papers to your new solicitors. You should appoint new lawyers that are on the Capital Home Loans conveyancing panel and notify the lender. If you have paid over any money it will hopefully be held by the SRA as money in an intervened firm's bank accounts is transferred to the SRA. Then, the SRA or the intervention agent looks at the intervened firm's accounts to work out who the money belongs to. To claim your money you will need to contact the SRA. If the SRA cannot return money you are owed from the firm's bank accounts, or if they can only return part of the money, you can apply to the Compensation Fund for a grant. Your new lawyers should be in a position to help
Are all Conveyancing Quality Solicitors on the Capital Home Loans conveyancing panel?
It is true that some banks and building societies now use the accreditation scheme as the starting point for Panel membership such as HSBC and Santander. The Law Society’s CQS accreditation however gives no guarantee to lender panel acceptance. That being said, the Council of Mortgage Lenders have indicated that it is likely to become a pre-requisite for firms wishing to remain on their approved list of firms.
Is there a list of Capital Home Loans panel conveyancers on the CML Handbook Website?
No. There is no such tool on the Council of Mortgage Lenders or Building Society Association websites. Very few lenders make their panel listings available online.
I have agreed a price on a flat I spoke to a conveyancer previously used by my dad and he suggested retaining a solicitor approved by Capital Home Loans. The estate agent recommended two local firms so I asked Capital Home Loans if the 2 suggested solicitors are approved, which they are not. Capital Home Loans pointed out that either firm can fill out the appropriate forms to become approved. Do I (1) save myself the aggravation and use one of Capital Home Loans 's conveyancing panel solicitors (2) Use the local solicitor and accept there may be delays etc as they go through the approval process.
