My financial adviser has informed me that I have to pay Landmark Mortgages fees should I instruct my family lawyer. How good are the Landmark Mortgages conveyancing panel solicitors? I dont care which law firm I use as long as they're good and reasonably priced. Are there any Landmark Mortgages conveyancers you'd recommend?
Landmark Mortgages’s conveyancing panel is substantial so it would be advisable to check with the firms you are getting quotes from that they are on the panel. You can search by postcode on the search tool on this site to find solicitors that Landmark Mortgages will allow to act for them.
We are getting closer to an exchange and my mum and dad having sent the 10% deposit to my lawyer. I am now advised that as the deposit has not come from me my lawyer needs to make a notification to my lender Landmark Mortgages. I am advised that, being on the Landmark Mortgages conveyancing panel and acting on their behalf he must inform Landmark Mortgages if the balance of the mortgage advance is not just from me. I informed the bank about my parent’s contribution when I applied for the home loan so is it really necessary for this now to be an issue?
Your lawyer is obliged to check with Landmark Mortgages to make sure that they are aware that the balance of the purchase price is not from your own funds. Your solicitor can only report this to Landmark Mortgages if you agree, failing which, your lawyer must cease to continue acting.

You can use any solicitor you like but Landmark Mortgages then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the Landmark Mortgages solicitors panel
What are the common reasons for a lender such as Landmark Mortgages to withdraw a mortgage offer?
Lenders such as Landmark Mortgages can revoke their mortgage offer although this rarely happens. should Landmark Mortgages withdraw their offer they may or may not inform you or the lawyer as to the reasons why. There are various possible reasons but here are 5 examples:
- Many mortgage offers have an expiry date. Your lawyer should check this. Landmark Mortgages may amend or withdraw an offer before the end of its validation period if an offer extension is requested and following a re-evaluation of the property the value of the security is below a level which is acceptable to them.
- If the borrower informs Landmark Mortgages of a change in the loan amount agreed
- Situations where information provided by the borrower that enabled the lender to make a lending decision is fraudulent, incorrect or misleading.
- If the lender reasonably suspects that the applicant, borrower, mortgagor or guarantor is involved in any criminal or fraudulent activity, including trading in illegal drugs or other substances, theft, robbery, deception or other serious offences, or if the applicant borrower, mortgagor or guarantor has a conviction for any serious criminal offence, including theft, deception, fraud, robbery or trade in illegal drugs or other substances;
- If the lender reasonably believe that the applicant, borrower, mortgagor or guarantor is insolvent or is about to become insolvent or has or will have a petition presented or if any one or all enter into any arrangement with their creditors generally or if any one or all should suffer a material change in their financial circumstances
It is not clear whether my mortgage offer obliges me to make sure the lease term for the flat is extended prior to the completion date . I have telephoned Landmark Mortgages on various occasions and was told they are content with the situation and they would lend. My solicitor - who is on the Landmark Mortgages conveyancing panel- telephoned and was told not they would not lend in accordance with their CML Handbook minimum lease term requirements. I simply dont know who is right
Your lawyer has to follow the CML Handbook Part 2 requirements for Landmark Mortgages. Unless your lawyer obtains specific confirmation in writing that Landmark Mortgages will go ahead your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask Landmark Mortgages to contact your lawyer in writing confirming that they will accept the remaining number of years left on the lease.
I have instructed a lawyer having checked that they are on the Landmark Mortgages conveyancing panel. Does my lawyer arrange the survey of the property?

Having read lots of house buying,I note that it is considered advisable to get your house surveyed prior to buying it. When I asked my solicitor - who is on the Landmark Mortgages conveyancing panel - on this she said they don't do this and I need to contract an independent surveyor. is that correct?
Landmark Mortgages will need an independent valuation of the property. Your lawyer will not arrange this. Usually Landmark Mortgages will appoint their own surveyor to do this, and you will have to pay for it. Remember that this is a valuation for mortgage purposes and not a survey.
You may wish to consider appointing your own surveyor to carry out a survey or prepare a home buyers report on the property. It is up to you to satisfy yourself that the property is structurally sound before you buy it. If the survey or report reveals that building work is needed, you should tell your solicitor. You may wish to renegotiate with the seller.

Your lawyer will not organise the survey but they may be able to put you in touch with a local one that they recommend. RICS offers a find a surveyor service (just google it) where you can search for a qualified surveyor by postcode. As you are getting a mortgage with Landmark Mortgages you could contact your them to see if they have a list of approved surveyors.
