Q and A’s regarding the Aldermore Bank Solicitor Panel

My property lawyer is not listed on the Aldermore Bank Approved Panel. Can I still retain my family solicitor even though they are excluded from the Aldermore Bank panel of approved conveyancing solicitors?
You will need to have a conveyancer complete the legal work required when you take out a Aldermore Bank mortgage to buy your property. They’ll carry out all the necessary legal checks on the property, make sure that you’re properly registered as the owner and ensure that all the necessary mortgage documentation is in place. You can instruct a conveyancing firm of your choice. However, if the firm selected is not a member of the Aldermore Bank conveyancing panel additional costs will be incurred as separate legal representation will be required by Aldermore Bank. Conveyancing panel applications can be submitted, so if your conveyancer has not previously applied for membership they can do so.
My fiance and I intend to remortgage our apartment with Aldermore Bank. We have a son 19 who lives with us. The solicitor on the Aldermore Bank conveyancing panel requested us to identify any adults other than ourselves who lives in the flat. Our lawyer has now e-mailed a document for our son to sign, giving up any rights in the event that the flat is forfeited by the lender. I have a couple of concerns (1) Is this form unique to the Aldermore Bank conveyancing panel as he never had to sign this form when we bought 5 years ago (2) Does our son by signing this giving up his rights to inherit the property?
First, rest assured that your Aldermore Bank conveyancing panel solicitor is doing the right thing as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to Aldermore Bank .This is solely used to protect the Aldermore Bank if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave.

It does not impact your son’s right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of Aldermore Bank had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.

After much negotiation I have agreed a price on a house. My financial adviser pressured me to appoint their lawyers I paid an upfront payment of 150. Soon after the conveyancers contacted me to say that they were not on the Aldermore Bank conveyancing panel. Am I right in thinking that I should be due a refund?
You should be able to recover this from the law firm if they were not on the Aldermore Bank panel. They should have asked at the outset which lender you were obtaining a mortgage with. An important lesson to readers of this site is to check that the lawyers are on the appropriate lender panel.
I was told three weeks ago that my mortgage has been agreed to by Aldermore Bank. Is it usual for Aldermore Bank to only issue the offer once my solicitor is approved on their conveyancing panel?
