Is there a reason why all UK lawyers are not on the Adam & Company Conveyancing panel?
Even though it may seem unfair for Adam & Company to restrict who can act for them from the public’s or solicitor’s point of view, the other side of the coin is that the lenders are becoming ever more anxious and feel the necessary need to protect them from mortgage fraud and other illegal activities. As a result of this concern Adam & Company have restricted their conveyancing panel to a manageable size. The Adam & Company lawyer panel is not the most exclusive of all lenders
My lawyer has identified an inconsistency when comparing the information in Adam & Company’s valuation survey and what is revealed within the conveyancing documents. My lawyer informs me that as he is on the Adam & Company conveyancing panel he is obliged to ensure that the lender is happy with this discrepancy and is still content to lend. Is my solicitor’s course or action right?
A precondition to being on the Adam & Company approved panel is to comply with the CML Handbook requirements (last updated for this lender on Adam & Company) which do require that your lawyer disclose any incorrect assumptions in the lender’s valuation report and the legal papers. Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for both parties.

The solicitors that just started acting on my purchase in London has suddenly closed. I only went with them because I had to have a solicitor on the Adam & Company conveyancing panel and my preferred lawyer was not. I paid them £200 on account. What are my options?
Assuming that you have an Estate Agent in the equation then inform them straight away so that they can let the sellers know that there may be a slight delay due to reasons beyond your control. Most sellers would be sympathetic and urge their lawyer to send a new set of papers to your new solicitors. You should appoint new lawyers that are on the Adam & Company conveyancing panel and notify the lender. If you have paid over any money it will hopefully be held by the SRA as money in an intervened firm's bank accounts is transferred to the SRA. Then, the SRA or the intervention agent looks at the intervened firm's accounts to work out who the money belongs to. To claim your money you will need to contact the SRA. If the SRA cannot return money you are owed from the firm's bank accounts, or if they can only return part of the money, you can apply to the Compensation Fund for a grant. Your new lawyers may be able to help
I have a mortgage with Adam & Company. Conveyancing was finalised a year ago. If I am intending to rent out my property and do not currently have a buy-to-let mortgage do I need to remortgage to a BTL mortgage or inform Adam & Company?
Adam & Company must be informed of your intention before letting out your property as this is likely to be a breach of Adam & Company’s mortgage conditions. It may be that Adam & Company will permit you to let out your former home without needing to switch to a buy-to-let mortgage but some lenders will add a surcharge to your mortgage rate to reflect the higher risk. You should contact Adam & Company directly. You need not do this via a Adam & Company conveyancing panel firm.
It is not clear whether my mortgage offer requires a lease extension . I have called Adam & Company on various occasions and told it wasn't a problem and they would lend. My solicitor - who is on the Adam & Company conveyancing panel- telephoned and was told not they would not lend in accordance with their CML Handbook minimum lease term requirements. Who do I believe?
Your lawyer has to follow the CML Handbook Part 2 requirements for Adam & Company. Unless your lawyer obtains specific confirmation in writing that Adam & Company will go ahead your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask Adam & Company to contact your lawyer in writing confirming that they will accept the remaining number of years left on the lease.
