Nedbank’s approved solicitor list is, like many other lenders represented by the Council or Mortgage Lenders or BSA, open to Licensed Conveyancers regulated by the Council of Licensed Conveyancers.
Much to my surprise my solicitor has requested from me proof of ID documents stating that this is part of his retainer as a solicitor on the Nedbank Conveyancing panel. This is news to me - can I refuse?

Given that you are obtaining a mortgage with Nedbank your lawyer must to check the Nedbank conveyancing instructions contained in the Part of CML Handbook for Nedbank . The CML Handbook contains minimum requirements for solar panel roof-space leases, and solicitors are required to report to Nedbank where a lease does not meet these requirements. The requirements relate to the installation of panels on properties in England and Wales. The CML are developing guidance for Northern Ireland and Scotland.
Why might a lender such as Nedbank withdraw a mortgage offer?
Lenders such as Nedbank can withdraw their mortgage offer although this rarely happens. If Nedbank withdraw their offer they may or may not inform you or the lawyer as to the reasons why. There are various possible reasons but here are a number of examples:
- Nedbank may amend or withdraw an offer if the Nedbank conveyancing panel solicitor is unable to confirm compliance with any of the conditions of the mortgage offer or if any of the terms of the mortgage offer cannot be satisfied
- Where to proceed with the Mortgage offer would be unlawful
- Where the lender has to take account a recent change in law
- Where the lender is on notice of a restriction or a right of pre-emption which is not at market value
- If the solicitor on the Nedbank conveyancing panel acting for the applicant, borrower, mortgagor or guarantor cannot comply with Nedbank ‘s instructions
We have agreed a price on a house I spoke to a solicitor recommended by my uncle and he recommended retaining a solicitor approved by Nedbank. The estate agent recommended two local firms so I asked Nedbank if the 2 suggested solicitors are approved, which they are not. Nedbank pointed out that either firm can fill out the appropriate forms to become approved.
