I have just been informed by my mortgage adviser that my lawyer is not on the M&S Bank Solicitor panel. What can I do to be certain that this is indeed the case?

You will need to appoint solicitors independently although you'll need to choose one on the M&S Bank conveyancing panel. The solicitor represents both you and the M&S Bank through the process.
I have today made my last payment due on mortgage with M&S Bank. I assume I don't need a solicitor on the M&S Bank panel to remove the mortgage at the Land Registry. Please confirm
If you have finished paying off your M&S Bank mortgage they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the M&S Bank mortgage from the register. M&S Bank,and any evidence they send you, will determine the action you need to take. Although you do need to retain the services of a lawyer they dont need to be on the M&S Bank panel. You will need a solicitor to draw up the transfer and to deal with the Land Registry formalities. The only thing you need to consider is that by selling at an undervalue so ask your lawyer about the implications. There could be an inheritance tax issue if you die within 7 years of this. As the property is your main residence you need not pay CGT but you should speak with your accountants in any event.
