I was advised recently by my mortgage adviser that my lawyer is not on the Bank of Ireland Mortgages Solicitor panel. What can I do to check?
The first thing you need to do is to contact your lawyer directly. You lawyer should advise you what has happened. If they are not on the panel they may recommend you to a firm that is on the the approved Bank of Ireland Mortgages solicitor panel.
Please help. My conveyancer is advising me that he has to conduct a Local Authority search as the firm are on the Bank of Ireland Mortgages solicitor panel. The searches cost a lot of money. Can this be avoided?
You have limited options available to you. As you are taking a mortgage with Bank of Ireland Mortgages your lawyer has to comply with their conditions as set out in their version of the CML Conveyancing Handbook. Your lawyer would have previously signed the Terms and Conditions of Bank of Ireland Mortgages’s conveyancing panel appointment which obliges them to follow the CML Handbook requirements last updated Bank of Ireland Mortgages. even if you were a cash buyer you would be ill advised not to carry out a local authority search.

I was scheduled to move into my first house two days ago. My lawyer’s firm is on the Bank of Ireland Mortgages conveyancing panel but has changed address in the past couple of months and had not advised Bank of Ireland Mortgages of their new address. Bank of Ireland Mortgages has locked down the release of mortgage funds until such time as their systems are up to date with the correct details.
This is a rare situation indeed. The majority of lender Terms of Conveyancing Panel Appointment specifically oblige the solicitor to inform the lender of an address change. Your solicitor needs to treat this with the utmost urgency. Do speak with or register your concern with the senior partner (assuming he or she is not your direct lawyer). Most lenders would be reasonable in this situation and expedite the resolution of this issue. It may be prudent to enlist the help of your local Bank of Ireland Mortgages branch or your mortgage broker to see if they can help.
It is not clear whether my mortgage offer obliges me to make sure the lease term for the flat is extended prior to the completion date . I have called into my local branch Bank of Ireland Mortgages on various occasions and told it wasn't a problem and they would lend. As long as the conveyancer is on the Bank of Ireland Mortgages panel she or he must comply with the CML Handbook requirements for Bank of Ireland Mortgages. Unless your lawyer obtains specific confirmation in writing that Bank of Ireland Mortgages will go ahead your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask Bank of Ireland Mortgages to contact your lawyer in writing confirming that they will accept the remaining number of years left on the lease.
I am selling my apartment. I had a double glazing fitted in month 6 but did not receive a FENSA certificate or Building Regulation Certificate. My buyer's lender, Bank of Ireland Mortgages are being difficult. The solicitor who is on the Bank of Ireland Mortgages conveyancing panel is happy to accept ‘lack of building regulation’ insurance but Bank of Ireland Mortgages are insisting on a building regulation certificate. Why do Bank of Ireland Mortgages have a conveyancing panel of they don’t accept advice from them?
It is probably the case that Bank of Ireland Mortgages have referred the matter to their valuer. The reason why Bank of Ireland Mortgages may not want to accept indemnity insurance is because it does not give them any reassurance that the double glazing correctly and safely installed. It merely protects against enforcement action which is very unlikely anyway.

Mortgage companies tend not to not issue an offer until they have details of a lawyer on their panel. It can take a few weeks for Bank of Ireland Mortgages to deal with your lawyers application to be on the Bank of Ireland Mortgages conveyancing panel. There's no guarantee that your solicitors will be accepted.
