My Solicitor has never been on on the RBS (One Account) Conveyancing Panel. Can I still continue with my family solicitor notwithstanding that they are excluded from the RBS (One Account) list of approved lawyers?
You will need to have a conveyancer complete the legal work required when you take out a RBS (One Account) mortgage to buy your property. They’ll carry out all the necessary legal checks on the property, make sure that you’re properly registered as the owner and ensure that all the necessary mortgage documentation is in place. You can instruct a conveyancing firm of your choice. However, if the firm selected is not a member of the RBS (One Account) conveyancing panel additional costs will be incurred as separate legal representation will be required by RBS (One Account). Conveyancing panel applications can be submitted, so if your conveyancer has not previously applied for membership they can do so.
Our solicitor has discovered a problem with the lease for the flat we are buying. The seller’s lawyers have offered defective title insurance as a solution. Just because you have a mortgage offer from RBS (One Account) does not mean to say that the property will be meet their requirements for the purposes of a mortgage. Your lawyer has to ensure that the lease has to comply with the CML Handbook Requirements. You and RBS (One Account) are the client. These conveyancing instructions have to be complied with by the RBS (One Account) conveyancing panel who has to balance acting for you and RBS (One Account)
Having used your search tool I can't find the lawyer I was hoping to instruct as being on the RBS (One Account) conveyancing panel. My lawyer has said that they are on the RBS (One Account) approved panel. How can I be sure given that they are not listed on your directory?
Not all firms are yet listed on our lender panel search tool which is still relatively new. Law firms are listing on a daily basis and it is probably the case that your lawyer is on the RBS (One Account) conveyancing lawyer and you should probably take them at their word. Please do feel free to suggest that they completing their listing on our site as it would only cost them £1 a month to list themselves as being on the RBS (One Account) solicitor panel.

Ordinarily, even if your lawyer is not on the RBS (One Account) conveyancing panel they can still act for you on your sale. it might be that the lender will not release the original deeds (if applicable and increasingly irrelevant) until after the mortgage is paid off. You should speak to your lawyer directly before you start the process though to ensure that there is no problem as lenders are changing their requirements fairly frequently at the moment.
Are all solicitors on the RBS (One Account) conveyancing panel regulated by the SRA?
As a firm of solicitors, in order to be on the RBS (One Account) conveyancing panel they would need to be regulated by the Solicitors Regulatory Authority. Many lenders do allow licenced conveyancers on their panel in which case such firms would be regulated by the Council of Licensed Conveyancers (CLC).

If you are getting a mortgage with RBS (One Account) involved you will need to appoint a solicitor on the RBS (One Account) conveyancing panel. We would not encourage you to both use the same solicitors' firm. There are clear conflict of interest issues and it's not going to make a huge difference to the speed of the overall process. So as not to hold things us you should pass on your solicitors details to RBS (One Account). I had an offer accepted on an apartment on the 5th February 2014, valuation was booked 3 days later, all came back fine. Conveyancer instructed, so all that was missing was my mortgage offer. Having made daily calls to RBS (One Account) and chasing them on my offer I have now been told that my offer will not be issued unless the lawyer is on the RBS (One Account) conveyancing panel. Can the lender hold off the offer?
Mortgage companies tend not to not issue an offer until they have details of a lawyer on their panel. It can take a few weeks for RBS (One Account) to deal with your lawyers application to be on the RBS (One Account) conveyancing panel. There's no guarantee that your solicitors will be accepted.
