Scottish Widows Conveyancing Panel : Questions and Answers

Am I correct in assuming that the fact that my solicitor is not isted on the Scottish Widows Conveyancing panel that there is a problem with the standard of the firm’s conveyancing?
It would not be wise to jump to that conclusion. There are all sorts of perfectly reasonable explanations. A recent report by the solicitors regulator indicated 76% of law firms surveyed had been removed from at least one lender panel. The most common reasons for removal are: (1) lack of transactions (2) the lawyer is a sole practitioner (3) as part of the HSBC panel reduction (4) regulatory contact by SRA (5) accidental removal. If you are concerned you should simply call the firm and ask them why they are no longer on the approved list for Scottish Widows.
My solicitor has identified a discrepancy between the assumptions in Scottish Widows’s home valuation report and what is revealed within the conveyancing documents. My lawyer informs me that as he is on the Scottish Widows conveyancing panel he is obliged to check that the lender is happy with this discrepancy and is content go ahead. Is my lawyer’s stance correct?
A precondition to being on the Scottish Widows approved panel is to comply with the CML Handbook requirements (last updated for this lender on Scottish Widows) which do require that your lawyer disclose any incorrect assumptions in the lender’s valuation report and the legal papers. Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for both parties.
Your search tool is useful but there are many lawyers listed near Manchester on the Scottish Widows conveyancing panel. It would be a lot more helpful if you could recommend a specific firm on the conveyancing panel for Scottish Widows ?
We do not recommend specific firms as the right firm for you depends on where your priorities lie. For example you may require a local firm with local knowledge or you might be looking for the low cost conveyancing. Before you appoint your lawyer we advise you to speak to two or three of the firms listed to gain comfort as to which one is right for you..
I am considering applying for a Scottish Widows mortgage for purchase of a new build (under development) with 60% LTV. Is it compulsory to choose a solicitor on the conveyancing panel for Scottish Widows?
There is nothing to stop you using your solicitor but Scottish Widows will insist on their interests being represented by a firm on their conveyancing panel. There is greater potential for delays and confusion with an additional lawyer added to the mix, and it will undoubtedly be more expensive too.
I was thinking of purchasing my friend’s property. Once we agree a price, what’s the best way to move forward? I hope to get a mortgage with Scottish Widows. Is there anyway to cut out the solicitors to save us both money? My dad reckons back in the day he did a lot of it himself, just went into the land registry office and providing them with the info they needed himself
If you are getting a mortgage with Scottish Widows involved you will need to appoint a solicitor on the Scottish Widows conveyancing panel. We would not encourage you to both use the same solicitors' firm. There are clear conflict of interest issues and it's not going to make a huge difference to the speed of the overall process. So as not to hold things us you should pass on your solicitors details to Scottish Widows. We expect to receive a DIP from Scottish Widows this week so we know how much we could potentially offer as otherwise we only have online calculators to go by (which aren't taking into account credit checks etc).Do the Scottish Widows recommend a solicitor on the Scottish Widows conveyancing panel, or is it better to go independently
You will need to appoint solicitors independently although you'll need to choose one on the Scottish Widows conveyancing panel. The solicitor represents both you and the Scottish Widows through the process.
