My mortgage broker has asked me for my law firm’s panel member for the Handelsbanken conveyancing panel. What is the best way to find this out. I have contacted my local Handelsbanken branch but they cant find it on their system.
the sensible thing to do is ask for this information from your solicitor. They should have a central record lender panel numbers including the Handelsbanken panel reference.
We are due to exchange on the purchase a house but as a result of damage from the recent storms I have agreed compensation from the seller of £3k approx by way of a reduction in the price. Your lawyer being on the Handelsbanken conveyancing panel is duty bound to inform Handelsbanken of any changes to the purchase price. If you were to refuse your lawyers to disclose the reduction to Handelsbanken then they would have to discontinue acting for you and Handelsbanken.

Can you clarify what the consequences are if my lawyer’s firm is suspended from the Handelsbanken Conveyancing panel prior to completion?
First, this is a very rare occurrence. In most cases even where a law firm is removed off of a panel the lender would allow the completion to go ahead as the lender would appreciate the difficulties that they would place you in if you have ti instruct a new solicitor days before completion. In a worst case scenario where the lender insists that you instruct a new firm then it is possible for a very good lawyer to expedite the conveyancing albeit that you may pay a significant premium for this. The analogous situation is where a buyer instructs a lawyer, exchanges contracts and the law firm is shut down by the regulator such as the SRA. Again, in this situation you can find lawyers who can troubleshoot their way to bring the conveyancing to a satisfactory conclusion - albeit at a cost.
Why might a lender such as Handelsbanken withdraw a mortgage offer?
Lenders such as Handelsbanken can revoke their mortgage offer although this rarely happens. should Handelsbanken withdraw their offer they may or may not inform you or the lawyer as to the reasons why. There are various possible reasons but here are a few examples:
  • A cashback to the buyer, or | part of the price includes a non-cash incentive to the buyer (eg paid stamp duty land tax),or | any indirect incentive (cash or non cash) or rental guarantee, of which the lender was previously unaware
  • Where to proceed with the Mortgage offer would be unlawful
  • Where the lender has to take account a recent change in law
  • Where the sale is not at arms length for value to unconnected persons
  • Where the lender is on notice of a restriction or a right of pre-emption which is not at market value
I currently have a mortgage with with Handelsbanken. Conveyancing was finalised some time ago. In the event that I decide to rent out my property and do not currently have a buy-to-let mortgage do I need to remortgage to a BTL mortgage or inform Handelsbanken?
Your original mortgage agreement with Handelsbanken will provide that you need their approval before letting out your property as this is likely to be a breach of Handelsbanken’s mortgage conditions. In many cases banks or building societies will permit you to let out your former home without needing to switch to a buy-to-let mortgage but some lenders will add a surcharge to your mortgage rate to reflect the higher risk. You should contact Handelsbanken directly. It should not be necessary to do this via a Handelsbanken conveyancing panel firm.
Handelsbanken have agreed my mortgage in principle, my offer on house has been accepted, now what?
The estate agent will want to know who your solicitors are (make sure these solicitors are on the lenders panel). Call up Handelsbanken or your broker and complete any relevant paperwork. Handelsbanken will tell you what documents they want. Handelsbanken will instruct a valuer. The valuer will get in touch with the estate agent or seller to book an appointment. Once conducted (assuming no problems) it takes about week to get a mortgage offer. Handelsbanken will issue the offer to you and your lawyer. The transaction will then take it’s course according the nature and complexity of the conveyancing.
