My property lawyer has never been on on the Nationwide BS Conveyancing Panel. Can I still retain my preferred solicitor notwithstanding that they are not on the Nationwide Building Society panel of approved conveyancing solicitors?
You have a number of options available to you here:
  1. Carry on with your existing lawyers but Nationwide BS will need to instruct a lawyer on the Nationwide Building Society conveyancing panel. This will result in additional cost and potential delay.
  2. Get a new solicitor to act in the purchase, obviously checking they are on the Nationwide BS conveyancing panel.
  3. Convince your lawyer to do everything within their powers to join the Nationwide BS conveyancing panel
Our lawyer is asking me for ID documents stating that this forms part of his requirements as a conveyancer on the Nationwide Building Society Solicitor panel. Am I being spun a yarn?
Due to Money Laundering Regulations your conveyancing lawyer is duty bound to confirm positively your identification when entering into a business relationship with you. It is a criminal offense if your lawyer not do this. If you do not provide ID early in the transaction the solicitor must refuse to act for you. It’s unlikely a lawyer will turn you away if you come to the first meeting without relevant ID but you will have to produce it at some point so you might as well bring it with you to the initial meeting so the lawyer can tick the ID verification box and start sorting out the conveyancing straight away. If you are getting a mortgage with Nationwide BS your lawyer also has to check ID documents to satisfy Nationwide Building Society

The fact that your lawyer is on the Nationwide BS conveyancing panel is a help. It would almost certainly delay matters if they were not. However, no conveyancer should guarantee a time-frame for your conveyancing due to third parties outside of our control such as delays caused by lenders,conveyancing search providers or by the other side’s solicitors. The time taken is often determined by the number of parties in a chain
When it comes to mortgage companies such as Nationwide Building Society do lawyers have to be pay a fee to be on the list of approved solicitors?
We are not aware of any lender fees to be on their panel although some do charge an administration charge to deal with the processing of the conveyancing panel application.
I have today made my last payment due on mortgage with Nationwide BS. I assume I don't need a solicitor on the Nationwide Building Society panel to remove the mortgage at the Land Registry. Please confirm
If you have finished paying off your Nationwide BS mortgage they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Nationwide Building Society mortgage from the register. Nationwide BS,and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage: but are not moving to another property where the Nationwide Building Society has sent the Land Registry the discharge electronically, and the Nationwide BS has instructed the Land Registry to do so The Land Registry will send you a letter confirming that your Nationwide Building Society mortgage has been paid off.
My offer was accepted on a house on the 17th February 2014, valuation was booked five days after, all came back fine. Property lawyer appointed, so the only thing outstanding was my mortgage offer. Having made daily calls to Nationwide BS and chasing them on my offer I have now been told that my offer will not be issued unless the lawyer is on the Nationwide Building Society conveyancing panel. Are Nationwide BS entitled to hold back the Mortgage pending the lawyer being on the approved list?
A lender would not issue an offer until they have details of a lawyer on their panel. It can take a few weeks for Nationwide Building Society to deal with your lawyers application to be on the Nationwide BS conveyancing panel. There's no guarantee that your solicitors will be accepted.
