My husband and I are purchasing a 1 bedroom apartment in Leeds with a mortgage from Danske Bank. We would like to retain our lawyer but Danske Bank says she’s not on their "panel". We have to appoint one of the Danske Bank panel firms or keep our solicitor and pay for one of their panel ones to represent them. This seems very unfair; Can we not simply insist that Danske Bank use our lawyer?
No, not really. The mortgage offered to you is subject to its terms and conditions, one of which will be that lawyers will on the Danske Bank conveyancing panel. Until recently, most lenders had large numbers of law firms on their panels: a borrower could choose one for themselves, as long as it was on the lender's panel. The lender would then simply instruct the borrower's lawyers to act for the lender, too. You can use your lender's panel lawyers or you could borrow from another lender which does not restrict your choice. A further alternative is for your lawyer to apply to be on the conveyancing panel for Danske Bank
My grandson is buying a new build apartment with a mortgage from Danske Bank. His solicitor has said that there is a delay in receiving the ‘Disclosure of Incentive Form’. This document is news to me - what is it and who needs sight of it?
The form is intended to provide information to the main parties involved in the transaction. Therefore, it will be provided to your son’s lawyer who should be on the Danske Bank conveyancing panel as a standard part of the process, and to the valuer when asked.

The Developer will be required to start the process by downloading the form and completing it.

The form will therefore need to be available for the valuer at the time of his or her site visit. The form should be sent to the Danske Bank conveyancing panel solicitor as early as possible, in order to avoid any last minute delays, and no later than at exchange of contracts.

I am looking for competitive conveyancing fees. Can I be assured that all the practices that are identified on your website are on the Danske Bank conveyancing panel?
The solicitor and licensed conveyancing practices on our directory have assured us via an online form that they are on the Danske Bank panel and agreed to advise us to take down their listing in the event of removal off of the Danske Bank panel. To date we have not been informed by either a lender or a member of the public that the data about a specific firm being on the Danske Bank conveyancing panel is not accurate.
My conveyancers in London have advised me that no longer have my conveyancing file. At the time of my purchase I took out a mortgage with Danske Bank. Is it case that being on the Danske Bank conveyancing panel they need to have retained the file for a prescribed period?
It very much depends from lender to lender but many of the Terms and Conditions of Conveyancing Panel Appointment require the file to be held for a period of 6 years. That being said we have not seen a copy of the Danske Bank Conveyancing Panel Terms. It might be worth you contacting Danske Bank directly.
I have paid off my mortgage with Danske Bank. I assume I don't need a solicitor on the Danske Bank panel to remove the mortgage at the Land Registry. Please confirm

I have a mortgage with Danske Bank. My grandfather retired last week and wants to pay off the mortgage left on the property. After Danske Bank is paid, I want to transfer the property to my mother's name; How long will it roughly take? Do we need two separate solicitors on the Danske Bank conveyancing panel? I do not intend to live at the property once the Danske Bank mortgage is discharged.
You will need a solicitor but they need not be on the Danske Bank conveyancing panel. You will need a solicitor to draw up the transfer and to deal with the Land Registry formalities. The only thing you need to consider is that by selling at an undervalue so ask your lawyer about the implications. There could be an inheritance tax issue if you die within 7 years of this. There's no capital gains tax for you as it is your main residence.
My offer on house has been accepted, but there is a chain. The vendors have offered on somewhere, but not been accepted yet, and have viewings of other properties booked. My conveyancing solicitor has been instructed. What do I do now? At what point should I appy for the mortgage with Danske Bank?
It is usual to have concerns where there is a chain as you are unlikely to want to be too out of pocket too early (mortgage application is approx £1k, then survey/valuation, conveyancing search costs, etc). First you should check that your solicitor is on the Danske Bank conveyancing panel. As to the next stages this very much depends on the circumstances of your case, desire for this property and on the state of the market. In a hot mortgage some buyers would pally for the mortgage with Danske Bank and pay for the valuation and only if it comes back ok would they pay their solicitor to press on with searches.
