I am getting a offer of a mortgage from Danske Bank. I intend to instruct a Licensed Conveyancer. Does the Danske Bank Conveyancing panel allow for Licensed Conveyancers
Danske Bank’s conveyancing panel is, like many other lenders represented by the CML or Building Society Association, open to Licensed Conveyancers regulated by the Council of Licensed Conveyancers.
Expecting to move into my new home next Monday. My conveyancing lawyer has asked me to provide him with a copy of the building insurance for the house as he says that he has to check this in has capacity as lawyer for Danske Bank. What does the insurance need to cover?
Any lawyer on the Danske Bank conveyancing panel would need to check that the following risks are covered fire; lightning; aircraft; explosion; earthquake; storm; flood; escape of water or oil; riot; malicious damage; theft or attempted theft; falling trees and branches and aerials; subsidence; heave;landslip;collision;accidental damage to underground services;professional fees, demolition and site clearance costs; and public liability to anyone else. There are some other issues such as the level of excess that are set out in Danske Bank’s Part 2 requirements of the CML Handbook (last updated on Danske Bank). Being on the Danske Bank conveyancing panel your lawyer is expect to follow these requirements.
I have been Googling for conveyancing quotes online. Can I be confident that all the law firms that are identified on your website are on the Danske Bank conveyancing panel?
The law firms on our directory have assured us via an online form that they are on the Danske Bank panel and agreed to advise us to take down their listing in the event of removal off of the Danske Bank panel. To date we have not been informed by either a lender or a member of the public that the data about a specific firm being on the Danske Bank conveyancing panel is not accurate.
The firm that just started acting on my purchase in Hendon has suddenly shut down. I chose them because I had to have a solicitor on the Danske Bank conveyancing panel and my family lawyer was not. I paid them £200 on account. What are my options?
Assuming that you have an Estate Agent in the equation then inform them straight away so that they can let the sellers know that there may be a slight delay due to reasons beyond your control. Hopefully they will be sympathetic and urge their lawyer to send a new set of papers to your new solicitors. You should appoint new lawyers that are on the Danske Bank conveyancing panel and notify the lender. If you have paid over any money it will hopefully be held by the SRA as money in an intervened firm's bank accounts is transferred to the SRA. Then, the SRA or the intervention agent looks at the intervened firm's accounts to work out who the money belongs to. To claim your money you will need to contact the SRA. If the SRA cannot return money you are owed from the firm's bank accounts, or if they can only return part of the money, you can apply to the Compensation Fund for a grant. Your new solicitors may be able to assist
Is there a list of Danske Bank panel conveyancers on the Council of Mortgage Lender’s Website?
No. There is no such tool on the Council of Mortgage Lenders or Building Society Association websites. Very few lenders make their panel listings available online.
I previously instructed online solicitors located in Bristol who are on the Danske Bank solicitor panel. They are now charging me a separate fee of £175 for dealing with the Danske Bank mortgage. Is this a supplemental conveyancing fee specified by Danske Bank?
Unfortunately, as long as it is in their Terms and Conditions or Quote then yes your solicitors can charge a fee for this. This fee is not set by Danske Bank but by your lawyers. Some firms on the Danske Bank will charge an ‘acting for lender’ fee but plenty of firms include it on their overall fee.
I recently had an offer accepted on a house. My mortgage broker suggested a solicitor I paid an upfront payment of 175. Soon after the conveyancers contacted me to say that they were not on the Danske Bank conveyancing panel. Am I right in thinking that I should be due a refund?
You should be able to recover this from the law firm if they were not on the Danske Bank panel. They should have asked at the outset which lender you were obtaining a mortgage with. An important lesson to readers of this site is to check that the lawyers are on the appropriate lender panel.
