The Land Registry need to see this evidence before they will remove the Family Building Society mortgage from the register. Family Building Society,and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage: but are not moving to another property where the Family Building Society has sent the Land Registry the discharge electronically, and the Family Building Society has instructed the Land Registry to do so The Land Registry will send you a letter confirming that your Family Building Society mortgage has been paid off.

    It is not advisable proceed with a house purchase without a solicitor. The council's solicitor are not acting for you. You need a solicitor for a number reasons. One of which is to verify what plans the Council have for repairs and refurbishment for the next five years. Many leaseholders have been stung for contributions of thousands of pounds. In any event if you are getting a mortgage with Family Building Society you will need to appoint a solicitor on the Family Building Society conveyancing panel.
  • I recently had an offer accepted on a house. My mortgage broker recommended their conveyancers I paid an upfront payment of 175.     You should be able to recover this from the law firm if they were not on the Family Building Society panel. They should have asked at the outset which lender you were obtaining a mortgage with. An important lesson to readers of this site is to check that the lawyers are on the appropriate lender panel.

    It is probably the case that Family Building Society have referred the matter to their valuer. The reason why Family Building Society may not want to accept indemnity insurance is because it does not give them any reassurance that the double glazing correctly and safely installed. It merely protects against enforcement action which is very unlikely anyway.

    Mortgage companies tend not to not issue an offer until they have details of a lawyer on their panel. It can take a few weeks for Family Building Society to deal with your lawyers application to be on the Family Building Society conveyancing panel. There's no guarantee that your solicitors will be accepted.

    The most common options here are as follows:
    1. Complete the purchase with your existing solicitors but Family Building Society will need to instruct a lawyer on the Family Building Society conveyancing panel. This will result in additional cost and potential delay.
    2. Get a new solicitor to act in the purchase, obviously checking they are on the Family Building Society conveyancing panel.
    3. Urge your lawyer to apply to join the Family Building Society lender panel
  • Is there a reason why all solicitors are not on the Family Building Society Conveyancing panel?
    Family Building Society and other lenders normally restrict either the type or the number of conveyancing firms on their panel. A common example of such restriction(s) being that a firm must have two or more partners. In addition to restricting the type of firm, some have decided to limit the number of firms they use to represent them.   • I am selling my flat and the EA has just called to say that the buyers are changing their conveyancer. The reason given is that Family Building Society will only deal with solicitors on their conveyancing panel. Why would a big named lender only deal with certain solicitors?
    Lenders have always had panels of law firms they are willing to work with, but in the past few years big names such as Santander, have reviewed and reduced their conveyancing panel– in some cases removing conveyancing firms who have worked with them for more than 25 years.

    Lenders blame a rise in fraud as the reason for the cull – criteria have been tightened and a smaller panel should be easier to keep an eye on. No lender will say how many solicitors have been dropped, claiming the information is commercially sensitive, but the Law Society says it is hearing daily from firms that have been removed from panels, or have other concerns about them. Some do not even realise they have been dropped until contacted by a borrower who has instructed them as might be the situation in your buyer's case. Your purchasers are unlikely to have any sway in the decision.

    No, not really. The mortgage offered to you is subject to its terms and conditions, one of which will be that lawyers will on the Family Building Society conveyancing panel. Until recently, most lenders had large numbers of law firms on their panels: a borrower could choose one for themselves, as long as it was on the lender's panel. The lender would then simply instruct the borrower's lawyers to act for the lender, too. You can use your lender's panel lawyers or you could borrow from another lender which does not restrict your choice. Another option that might be available is for your lawyer to apply to be on the conveyancing panel for Family Building Society

    Anti-terror and anti-money-laundering rules require solicitors and licensed conveyancers to verify the identity of the person or body they are dealing with before they can accept their conveyancing business. The Terms and Conditions that you need to sign will no doubt confirm this. Your lawyer is right that Family Building Society also require certain documents to be viewed. If a you refuse to provide ID verification documents, your conveyancer would not be able to accept instructions from you.     Unfortunately both you and your lawyer have little choice here. As you are taking a mortgage with Family Building Society your lawyer has to comply with their conditions as set out in their version of the UK Finance Mortgage Lenders' Handbook. Your lawyer would have previously signed the Terms and Conditions of Family Building Society's conveyancing panel appointment which obliges them to follow the UK Finance Mortgage Lenders' Handbook requirements last updated Family Building Society. even if you were a cash buyer you would be ill advised not to carry out a local authority search.

    You should not exchange unless you have advised to do so by your lawyer. A precondition to being on the Family Building Society approved panel is to comply with the UK Finance Mortgage Lenders' Handbook requirements (last updated for this lender on Family Building Society). The UK Finance Mortgage Lenders' Handbook requires that your lawyer have the appropriate Disclosure of Incentive form completed by the developer and accepted by your lender.

    Any lawyer on the Family Building Society conveyancing panel would need to check that the following risks are covered fire; lightning; aircraft; explosion; earthquake; storm; flood; escape of water or oil; riot; malicious damage; theft or attempted theft; falling trees and branches and aerials; subsidence; heave;landslip;collision;accidental damage to underground services;professional fees, demolition and site clearance costs; and public liability to anyone else. There are some other issues such as the level of excess that are set out in Family Building Society's Part 2 requirements of the UK Finance Mortgage Lenders' Handbook (last updated on Family Building Society). Being on the Family Building Society conveyancing panel your lawyer is expect to follow these requirements.
  • My wife and I are refinancing our apartment with Family Building Society. We have a son 19 who lives with us. The solicitor on the Family Building Society conveyancing panel requested us to identify any adults other than ourselves who reside at the property. The solicitor has now sent a form for our son to sign, giving up any rights in the event that the flat is repossessed. I have two questions (1) Is this form unique to the Family Building Society conveyancing panel as he never had to sign this form when we purchased 3 years ago (2) Does our son by signing this giving up his rights to inherit the property?
    First, rest assured that your Family Building Society conveyancing panel solicitor is doing the right thing as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to Family Building Society.This is solely used to protect the Family Building Society if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave.

    It does not impact your son's right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of Family Building Society had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.

    The Developer will be required to start the process by downloading the form and completing it.
