What is the rationale as to why all solicitors are not on the Hampden Conveyancing panel?
Hampden and other lenders ordinarily imposes restrictions either the type or the number of conveyancing solicitors on their approved list of lawyers. A common example of such restriction(s) being that a firm must have two or more partners. In addition to restricting the type of firm, some have decided to limit the number of firms they use to represent them. You should note that Hampden have no responsibility for the quality of advice provided by any member of Hampden Conveyancer Panel. Mortgage fraud was a key driver in the rationalisation of conveyancing panels a few years ago and whilst there are differing views about the extent of solicitor involvement in some of that fraud. Statistics from the Land Registry reveal that thousands of law firms only carry out one or two conveyances a year. Those supporting conveyancing panel cuts ask why law firms should have the right to be on a Lender panel when clearly, Conveyancing is not their speciality? To put it another way; would you want a conveyancing solicitor to represent you if you were charged with a crime; probably not.
Our conveyancer has discovered a legal deficiency with the lease for the apartment we are buying. The other side have suggested defective title insurance as a workaround. The short answer to your last question is that, notwithstanding the potential for a conflict of interest, you and Hampden are the client. A precondition to being on the Hampden approved panel is to comply with the CML Handbook requirements (last updated for this lender on Hampden). The CML Handbook conditions require your lawyer to disclose issues such as defects will the lease so that Hampden can be afforded the opportunity to check with their valuer as to the extent that the value of the property is affected . Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for you.

We do not recommend specific firms as the right firm for you depends on where your priorities lie. For example you may require a local firm with local knowledge or you might be looking for the low cost conveyancing. Before you appoint your lawyer we advise you to speak to two or three of the firms listed to gain comfort as to which one is right for you..
My house is up for sale and I have a buyer. Does my solicitor have to be on the Hampden conveyancing panel in order to deal with redeeming my mortgage?
Ordinarily, even if your lawyer is not on the Hampden conveyancing panel they can still act for you on your sale. it might be that the lender will not release the original deeds (if applicable and increasingly irrelevant) until after the mortgage is paid off. You should speak to your lawyer directly before you start the process though to ensure that there is no problem as lenders are changing their requirements fairly frequently at the moment.
is it true that all solicitors on the Hampden conveyancing panel regulated by the Solicitors Regulatory Authority?
As a firm of solicitors, in order to be on the Hampden conveyancing panel they would need to be regulated by the Solicitors Regulatory Authority. Many lenders do allow licenced conveyancers on their panel in which case such firms would be regulated by the Council of Licensed Conveyancers (CLC).
I previously instructed online conveyancers based in Bristol who are on the Hampden solicitor panel. They are now charging me a separate fee of £150 for dealing with the Hampden mortgage. Is this a supplemental conveyancing fee specified by Hampden?
Unfortunately, as long as it is in their Terms and Conditions or Quote then yes your solicitors can charge a fee for this. This fee is not set by Hampden but by your lawyers. Some firms on the Hampden will charge an ‘acting for lender’ fee but plenty of firms include it on their overall fee.
Hampden have agreed my mortgage in principle, my offer on house has been accepted, now what?
The estate agent will want to know who your solicitors are (make sure these solicitors are on the lenders panel). Call up Hampden or your broker and complete any relevant paperwork. Hampden will tell you what documents they want. Hampden will instruct a valuer. The valuer will get in touch with the estate agent or seller to book an appointment. Once conducted (assuming no problems) it takes about week to get a mortgage offer. Hampden will issue the offer to you and your lawyer. The transaction will then take it’s course according the nature and complexity of the conveyancing.
