    It would be sensible to have your start your search soon rather than later. Once you decide who you want to use and once your offer is accepted you can instruct them to work for you and pass their details on the the EA.   • I have paid off my mortgage with Investec. I assume I don't need a solicitor on the Investec panel to remove the mortgage at the Land Registry. Please confirm
    If you have finished paying off your Investec mortgage they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Investec mortgage from the register. Investec,and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage: but are not moving to another property where the Investec has sent the Land Registry the discharge electronically, and the Investec has instructed the Land Registry to do so The Land Registry will send you a letter confirming that your Investec mortgage has been paid off.
  • I am currently in the process of buying my council flat. I have a mortgage agreed with Investec. Conveyancing is new to me. Can I proceed without a solicitor easily? I think we can but we keep being told I should use one. Any advice?
    It is not advisable proceed with a house purchase without a solicitor. The council's solicitor are not acting for you. You need a solicitor for a number reasons. One of which is to verify what plans the Council have for repairs and refurbishment for the next five years. Many leaseholders have been stung for contributions of thousands of pounds. In any event if you are getting a mortgage with Investec you will need to appoint a solicitor on the Investec conveyancing panel.
  • Can I register a complaint to Investec about the lawyers being on the Investec conveyancing panel?
    There is little point in complaining directly to Investec. All solicitors and conveyancer must have a complaints procedure. You can get information from the solicitor's or conveyancer's website or ask at their office. They must tell you about it if you ask.

    The Legal Ombudsman will make sure that your complaint is properly dealt with by the solicitor. It can also advise you how to complain.

    If a licensed conveyancer does not have a complaints procedure or will not tell you about it, contact the Council for Licensed Conveyancers (CLC), which will make sure that your complaint is properly dealt with by the conveyancer. Please see below for more information.

  • It is not clear whether my mortgage offer requires a lease extension. I have telephoned Investec on numerous occasions and told it wasn't a problem and they would lend. My solicitor - who is on the Investec conveyancing panel- telephoned and was told not they would not lend in accordance with their UK Finance Mortgage Lenders' Handbook minimum lease term requirements. Who do I believe?
    As long as the conveyancer is on the Investec panel she or he must comply with the UK Finance Mortgage Lenders' Handbook requirements for Investec. Unless your lawyer obtains specific confirmation in writing that Investec will go ahead your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask Investec to contact your lawyer in writing confirming that they will accept the remaining number of years left on the lease.
  • I recently had an offer accepted on a house. My mortgage broker recommended their conveyancers I paid an upfront payment of 175. Soon after the conveyancers contacted me to say that they were not on the Investec conveyancing panel. Am I right in thinking that I should be due a refund?
    You should be able to recover this from the law firm if they were not on the Investec panel. They should have asked at the outset which lender you were obtaining a mortgage with. An important lesson to readers of this site is to check that the lawyers are on the appropriate lender panel.
  • I am selling my house. I had a double glazing fitted in month 2010 but did not receive a FENSA certificate or Building Regulation Certificate. My buyer's mortgage company, Investec are being a right pain. The solicitor who is on the Investec conveyancing panel is saying indemnity insurance will be fine but Investec are insisting on a building regulation certificate. Why do Investec have a conveyancing panel of they don’t accept advice from them?
    It is probably the case that Investec have referred the matter to their valuer. The reason why Investec may not want to accept indemnity insurance is because it does not give them any reassurance that the double glazing correctly and safely installed. It merely protects against enforcement action which is very unlikely anyway.
  • Intending to buy a flat with a mortgage with Investec. I have received an online quote from a licensed conveyancer, which states: "There will be no charge for dealing with the Building Society if you are obtaining a mortgage". I take this to mean that there will be no additional fee if the solicitor is on the Investec conveyancing panel. I wanted to make sure it means there will be no additional fees for dealing with the mortgage.
    They are simply saying that the cost for acting for the lender is included in the fee being quoted. It is worth you checking that they are on the Investec conveyancing panel
  • I have instructed a lawyer having checked that they are on the Investec conveyancing panel. Does my lawyer arrange the survey of the property? Or I've read lots of house buying,I note that they all recommend that you should get your house surveyed prior to buying it. When I asked my solicitor - who is on the Investec conveyancing panel - on this she said they don't do this and I need to contract an independent surveyor. Is that normal?
    Investec will need an independent valuation of the property. Your lawyer will not arrange this. Usually Investec will appoint their own surveyor to do this, and you will have to pay for it. Remember that this is a valuation for mortgage purposes and not a survey. You may wish to consider appointing your own surveyor to carry out a survey or prepare a home buyers report on the property. It is up to you to satisfy yourself that the property is structurally sound before you buy it. If the survey or report reveals that building work is needed, you should tell your solicitor. You may wish to renegotiate with the seller. or Your lawyer will not organise the survey but they may be able to put you in touch with a local one that they recommend. RICS offers a find a surveyor service (just google it) where you can search for a qualified surveyor by postcode. As you are getting a mortgage with Investec you could contact your them to see if they have a list of approved surveyors.
  • My ex -wife's name is on the Investec mortgage of my property but not on the land registry. The apartment was transferred to me on our divorce many years ago by way of a sealed court order. Does my ex still have a say on the sale even though the land registry showing the property in my name alone? Will I be required to take her name of the Investec mortgage in order to sell?
    In terms of the Investec mortgage, it is unusual that your ex-wife's name remains on the mortgage but not on the title. It is conceivable that this is an oversight on the part of your conveyancers to ensure that her name was removed or even an administrative error on the part of Investec in failing to update their data. In any event, it should cause difficulty providing her name no longer appears on the Land Registry title and you have a court order ordering that the property is transferred to you.

    No. There is no UK Finance Part 2 or Building Society Association requirement relating to online case tracking. Some law firms operate such technology and some don't.

UK Finance obligations

  • Much to my surprise my lawyer is asking me for ID documents saying that this is part of his requirements as a solicitor on the Investec Conveyancing panel. Is this right?
    Anti-terror and anti-money-laundering rules require solicitors and licensed conveyancers to verify the identity of the person or body they are dealing with before they can accept their conveyancing business. The Terms and Conditions that you need to sign will no doubt confirm this. Your lawyer is right that Investec also require certain documents to be viewed. If a you refuse to provide ID verification documents, your conveyancer would not be able to accept instructions from you. Your lawyer also has obligations to obtain certain documents in accordance with Investec UK Finance Mortgage Lenders' Handbook requirements last updated on Investec
  • Our lawyer has identified a defect with the lease for the property we are buying. The other side have suggested title insurance as a solution. We are happy with insurance and will pay for it. Our solicitor says that as he is on the Investec conveyancing panel he must check that the lender is happy with this solution. Are we the client or is Investec?
    The short answer to your last question is that, notwithstanding the potential for a conflict of interest, you and Investec are the client. A precondition to being on the Investec approved panel is to comply with the UK Finance Mortgage Lenders' Handbook requirements (last updated for this lender on Investec). The UK Finance Mortgage Lenders' Handbook conditions require your lawyer to disclose issues such as defects will the lease so that Investec can be afforded the opportunity to check with their valuer as to the extent that the value of the property is affected. Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for you.
  • My lawyer has identified an inconsistency between the assumptions in Investec's valuation report and what is in the conveyancing documents. My solicitor says that as he is on the Investec conveyancing panel he must check that the lender is happy with this discrepancy and is still content to lend. Is my lawyer's stance right?
    A precondition to being on the Investec approved panel is to comply with the UK Finance Mortgage Lenders' Handbook requirements (last updated for this lender on Investec) which do require that your lawyer disclose any incorrect assumptions in the lender's valuation report and the legal papers. Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for you.
  • I am due to complete my purchase next Monday. My conveyancing lawyer has asked me to provide him with a copy of the building insurance for the house as he says that he has to check this in has capacity as lawyer for Investec. What risks do Investec expect the insurance to cover?
    Any lawyer on the Investec conveyancing panel would need to check that the following risks are covered fire; lightning; aircraft; explosion; earthquake; storm; flood; escape of water or oil; riot; malicious damage; theft or attempted theft; falling trees and branches and aerials; subsidence; heave;landslip;collision;accidental damage to underground services;professional fees, demolition and site clearance costs; and public liability to anyone else. There are some other issues such as the level of excess that are set out in Investec's Part 2 requirements of the UK Finance Mortgage Lenders' Handbook (last updated on Investec). Being on the Investec conveyancing panel your lawyer is expect to follow these requirements.
  • We are nearing an exchange and my parents having sent the 10% deposit to my lawyer. I am now advised that as the deposit has not come from me my lawyer needs to disclose this to my lender Investec. Apparently, being on the Investec conveyancing panel and acting on their behalf he must inform Investec if the balance of the mortgage advance is not just from me. I informed the bank about my parent's contribution when I applied for the mortgage so is it really necessary for him to raise this?
    Your lawyer is obliged to check with Investec to make sure that they are aware that the balance of the purchase price is not from your own funds. Your solicitor can only report this to Investec if you agree, failing which, your lawyer must cease to continue acting.
  • My son is buying a new build apartment with a mortgage from Investec. His lawyer has said that there is a delay in completing the 'Disclosure of Incentive Form'. Who needs to receive the form?
    The form is intended to provide information to the main parties involved in the transaction. Therefore, it will be provided to your son's lawyer who should be on the Investec conveyancing panel as a standard part of the process, and to the valuer when requested.

    The Developer will be required to start the process by downloading the form and completing it.

    The form will therefore need to be available for the valuer at the time of his or her site visit. The form should be sent to the Investec conveyancing panel solicitor as early as possible, in order to avoid any last minute delays, and no later than at exchange of contracts.

Unusual conveyancing

  • I am buying a garden flat and getting a mortgage with Investec. Conveyancing solicitors are said to be 'a necessary evil' but can I do it myself?
    Leaving aside the complexities and merits of DIY conveyancing you will have to appoint a solicitor on the Investec conveyancing panel to look after their interests. Most people therefore find it easier to let the solicitor act for them and the lender. Furthermore there is minimal cost savings to made in you doing to conveyancing for yourself and another lawyer conducting the conveyancing for the lender.   • What happens if my solicitor is removed from the Investec Conveyancing panel before the completion date?
    First, this is very unlikely to happen. In most cases even where a law firm is removed off of a panel the lender would allow the completion to go ahead as the lender would appreciate the difficulties that they would place you in if you have ti instruct a new solicitor days before completion. In a worst case scenario where the lender insists that you instruct a new firm then it is possible for a very good lawyer to expedite the conveyancing albeit that you may pay a significant premium for this. The analogous situation is where a buyer instructs a lawyer, exchanges contracts and the law firm is shut down by the regulator such as the SRA. Again, in this situation you can find lawyers who can troubleshoot their way to bring the conveyancing to a satisfactory conclusion - albeit at a cost.
  • My conveyancers in London have advised me that no longer have my conveyancing file. At the time of my purchase I took out a mortgage with Investec. Is it case that being on the Investec conveyancing panel they need to have retained the file for a number of years?
    It very much depends from lender to lender but many of the Terms and Conditions of Conveyancing Panel Appointment require the file to be held for a period of 6 years. That being said we have not seen a copy of the Investec Conveyancing Panel Terms. It might be worth you contacting Investec directly.
  • We're in London, FTBs buying with a mortgage (lender is Investec, but our solicitor is on the Investec conveyancing panel). How long should the conveyancing process take?
    The fact that your lawyer is on the Investec conveyancing panel is a help. It would almost certainly delay matters if they were not. However, no conveyancer should guarantee a time-frame for your conveyancing due to third parties outside of our control such as delays caused by lenders,conveyancing search providers or by the other side's solicitors. The time taken is often determined by the number of parties in a chain
  • I was scheduled to complete on my first house yesterday. My solicitor is on the Investec conveyancing panel but has changed address in the past couple of months and had not advised Investec of their new address. Investec is now refusing to release my funds as the information from the solicitors isn't correct.
    This is a rare situation indeed. The majority of lender Terms of Conveyancing Panel Appointment specifically oblige the solicitor to inform the lender of an address change. Your solicitor needs to treat this with the utmost urgency. Do speak with or register your concern with the senior partner (assuming he or she is not your direct lawyer). Most lenders would be reasonable in this situation and expedite the resolution of this issue. It may be prudent to enlist the help of your local Investec branch or your mortgage broker to see if they can assist.
  • My uncle passed away last year and as sole heir and executor was left the house. The house had a small mortgage left on it of around £8000. I want to transfer the title deeds into my name whilst I re-mortgage to Investec, pay off the mortgage etc. Is this allowed?
    If you intend to re-mortgage then Investec will insist on your using a conveyancer on the Investec conveyancing panel. Here is link to the Land Registry online guidance around what to do when a property owner dies. This will help you to understand the registration process behind changing the details re the registered title. in your case it would appear that you are effectively purchasing the property from the estate. Your Investec conveyancing panel solicitor pays the new mortgage money into the estate, the estate pays off the old mortgage, the charge is released and you become the owner and the Investec mortgage is registered as a charge at the Land Registry.

  • My lawyer is not on the Investec Conveyancing Panel. Can I still use my preferred solicitor even though they are not on the Investec panel?
    The most common options here are as follows:
    1. Complete the purchase with your existing solicitors but Investec will need to instruct a lawyer on the Investec conveyancing panel. This will result in additional cost and potential delay.
    2. Get a new solicitor to act in the purchase, obviously checking they are on the Investec conveyancing panel.
    3. Urge your lawyer to apply to join the Investec lender panel
  • Is there a reason why all solicitors are not on the Investec Conveyancing panel?
    Investec and other lenders normally restrict either the type or the number of conveyancing firms on their panel. A common example of such restriction(s) being that a firm must have two or more partners. In addition to restricting the type of firm, some have decided to limit the number of firms they use to represent them. You should note that Investec have no responsibility for the quality of advice provided by any member of Investec Conveyancer Panel. Mortgage fraud was a key driver in the rationalisation of conveyancing panels a few years ago and whilst there are differing views about the extent of solicitor involvement in some of that fraud. Statistics from the Land Registry reveal that thousands of law firms only carry out one or two conveyances a year. Those supporting conveyancing panel cuts ask why law firms should have the right to be on a Lender panel when clearly, Conveyancing is not their speciality? To put it another way; would you want a conveyancing solicitor to represent you if you were charged with a crime; probably not.
  • I was advised recently by my broker that my solicitor is not on the Investec Conveyancing panel. How can I check?
    The best course of action for you to take is to contact your lawyer directly. It is reasonable to expect your lawyer to advise you of the situation. If they are not on the panel they may recommend you to a firm that is on the conveyancing panel for Investec.
  • Is the fact that my solicitor is not on the Investec Conveyancing panel that there is a problem with the standard of his work?
    That would more than likely be a wrong assumption to make. There are all sorts of perfectly reasonable explanations. A recent report by the solicitors regulator indicated 76% of law firms surveyed had been removed from at least one lender panel. The most common reasons for removal are: (1) lack of transactions (2) the lawyer is a sole practitioner (3) as part of the HSBC panel reduction (4) regulatory contact by SRA (5) accidental removal. If you are concerned you should simply call the firm and ask them why they are no longer on the approved list for Investec.
  • My mortgage broker has asked me for my solicitor's panel member for the Investec conveyancing panel. How do I find this out. I have tried my local Investec branch but they don't know it.
    You are best placed to get this information from your conveyancing lawyer. They should have a central record lender panel numbers including the Investec panel reference.

    The answer depends on whether you still have confidence in the said solicitors and how long it will take for the firm to be reinstated on the Investec conveyancing panel You may wish to enlist the help of your broker to check with the Investec as to how long they think it will take to get the firm to get back on the panel.

    When purchasing a property with the benefit of a mortgage it is usual for the purchaser's solicitors to also act for the purchaser's lender.

    In order to act for a bank or building society a law firm has to be on that lender's conveyancing panel. An application has to be made by the law firm to the lender to become a member of the lender's panel and there are increasingly strict criteria which the firm has to satisfy and indeed some lenders now require their panel members to be part of the Law Society's Conveyancing Quality Scheme. Your solicitors should contact Investec and see if they can apply for membership of the Investec conveyancing panel, but if that is not viable Investec will instruct their own solicitors to act. You don't have to instruct a firm on the Investec conveyancing panel and you may continue to use your own solicitors, in which case it will likely add costs, and it may delay matters as you have another set of people involved.

  • How easy is it to change a solicitor as I need to find one who is on the Investec conveyancing panel. How easy is it to change conveyancer?
