Find an Approved Solicitor on the M&S Bank Conveyancing Panel

FAQs for the M&S Bank Solicitor Panel

I need to swap lawyers as my lawyer is not on the M&S Bank panel of conveyancing solicitors. Is it practical to instruct different lawyers?
If you haven't yet instructed a solicitor to do anything for you and have just received quotes, you're perfectly free to choose a different solicitor to carry out your work for you. The best way is to get recommendations from friends or family who have actually used the solicitor or conveyancer you're considering.
Our lawyer has uncovered a defect with the lease for the property we are buying. The seller’s lawyers have suggested title insurance as a solution. We are happy with insurance and will pay for it. Our lawyer has advised that as he is on the M&S Bank conveyancing panel he must check that the lender is happy with this solution. Who is the client here, us or M&S Bank?
The short answer to your last question is that, notwithstanding the potential for a conflict of interest, you and M&S Bank are the client. A precondition to being on the M&S Bank approved panel is to comply with the CML Handbook requirements (last updated for this lender on M&S Bank). The CML Handbook conditions require your lawyer to disclose issues such as defects will the lease so that M&S Bank can be afforded the opportunity to check with their valuer as to the extent that the value of the property is affected . Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for you.
I have been searching for competitive conveyancing fees. Can I be assured that all the firms that are identified on your directory are on the M&S Bank conveyancing panel?
The solicitor and licensed conveyancing practices listed on our site have advised us that they are on the M&S Bank panel and agreed to advise us to take down their listing in the event of removal off of the M&S Bank panel. To date we have not been informed by either a bank or a member of the public that the data about a specific firm being on the M&S Bank conveyancing panel is not accurate.
I am attempting to get my ex-husband removed the mortgage deeds. Can M&S Bank really tell me which solicitor I can or can not retain?
You can use any solicitor you like but M&S Bank then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the M&S Bank solicitors panel
I previously instructed online conveyancers based in Birmingham who are on the M&S Bank solicitor panel. They are now charging me a separate fee of £135 for dealing with the M&S Bank mortgage. Is this a supplemental conveyancing fee specified by M&S Bank?
Unfortunately, as long as it is in their Terms and Conditions or Quote then yes your solicitors can charge a fee for this. This fee is not set by M&S Bank but by your lawyers. Some firms on the M&S Bank will charge an ‘acting for lender’ fee and others do not.
We expect to receive a DIP from M&S Bank this week so we can work out what to offer on a property we like as otherwise we are dependent on web based calculators (which aren't taking into account credit checks etc).Do the M&S Bank recommend a solicitor on the M&S Bank conveyancing panel, or is it better to find our own lawyer
You will need to appoint solicitors independently although you'll need to choose one on the M&S Bank conveyancing panel. The solicitor represents both you and the M&S Bank through the process.
I have paid off my mortgage with M&S Bank. I assume I don't need a solicitor on the M&S Bank panel to remove the mortgage at the Land Registry. Am I right?
If you have finished paying off your M&S Bank mortgage they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the M&S Bank mortgage from the register. M&S Bank, and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage: but are not moving to another property where the M&S Bank has sent the Land Registry the discharge electronically, and the M&S Bank has instructed the Land Registry to do so The Land Registry will send you a letter confirming that your M&S Bank mortgage has been paid off.
