FAQs : The M&S Bank Conveyancing Panel

A lawyer my fiance and I had intended to instruct on a purchase said he will levy higher legal fees if my lender is due to their unusual legal requirements. Will I regret using M&S Bank? Is M&S Bank conveyancing so much more difficult?
M&S Bank conveyancing requirements for their panel are no better or no more complicated than most lenders. It is the case now the CML Handbook, the "bible" used by solicitors to establish lender requirements, is different for each lender. It is not clear if your lawyer is on the M&S Bank conveyancing panel. If they are not, this does add further risk of delay as M&S Bank will appoint their own solicitors to look after their interest.
We are due to exchange on the purchase a house but as a result of damage from the recent storms I have agreed compensation from the seller of £3k approx by way of a reduction in the price. This was going to be dealt with as part of the conveyancing process but my mortgage company M&S Bank will not agree to this. Why was M&S Bank even consulted?
Your lawyer being on the M&S Bank conveyancing panel is duty bound to inform M&S Bank of any changes to the purchase price. If you were to refuse your lawyers to disclose the reduction to M&S Bank then they would have to discontinue acting for you and M&S Bank.

I have paid off my mortgage with M&S Bank. I assume I don't need a solicitor on the M&S Bank panel to remove the mortgage at the Land Registry. Am I right?
If you have finished paying off your M&S Bank mortgage they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the M&S Bank mortgage from the register. M&S Bank, and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage: but are not moving to another property where the M&S Bank has sent the Land Registry the discharge electronically, and the M&S Bank has instructed the Land Registry to do so The Land Registry will send you a letter confirming that your M&S Bank mortgage has been paid off.
After much negotiation I have agreed a price on a house. My financial adviser pressured me to appoint their lawyers I paid an upfront payment of 200. Soon after the conveyancers contacted me to say that they were not on the M&S Bank conveyancing panel. Am I right in thinking that I should be due a refund?
You should be able to recover this from the law firm if they were not on the M&S Bank panel. They should have asked at the outset which lender you were obtaining a mortgage with. An important lesson to readers of this site is to check that the lawyers are on the appropriate lender panel.
