I instructed a solicitor to conduct the legal paperwork on my purchase 5 weeks ago having applied for a mortgage with Whistletree. The law firm confirmed to me that they are on Whistletree conveyancing panel and advised me their panel reference. Whistletree then called me to say that their panel number was dormant and would need to be reactivated. What do I do from here? Should I appoint a new solicitor currently on the approved panel for Whistletree?
You may be very frustrated with the lawyer but if it only go take a few more days they it may be worth waiting as, depending on how far progressed you are you may end up delaying the transaction by a number of weeks if you need to replace your solicitor You may wish to enlist the help of your broker to check with the Whistletree as to the time frame to get your lawyer reinstated on the panel once again.
I am buying a new build duplex and my solicitor is advising me that she is duty bound to disclose incentives from the seller as her firm is on the Whistletree conveyancing panel. I am nearing the developer’s deadline to exchange contracts and my preference is not to prolong the conveyancing. Is my lawyer right?
You should not exchange unless you have advised to do so by your lawyer. A precondition to being on the Whistletree approved panel is to comply with the CML Handbook requirements (last updated for this lender on Whistletree). The CML Conveyancing Handbook requires that your lawyer have the appropriate Disclosure of Incentive form completed by the developer and accepted by your lender.
Do all mortgage companies provide you with an approved list of solicitors? How do you know who is on the Whistletree conveyancing panel?

I was scheduled to complete on my flat last Thursday. My lawyer’s firm is on the Whistletree conveyancing panel but has moved offices 8 weeks ago and had not informed Whistletree of their new address. This is a rare situation indeed. The majority of lender Terms of Conveyancing Panel Appointment specifically oblige the solicitor to inform the lender of an address change. Your solicitor needs to treat this with the utmost urgency. Do speak with or register your concern with the senior partner (assuming he or she is not your direct lawyer). Most lenders would be reasonable in this situation and expedite the resolution of this issue. It may be prudent to enlist the help of your local Whistletree branch or your mortgage broker to see if they can assist.
Can you point me to a directory of Whistletree panel solicitors on the CML Handbook Website?
No. There is no such tool on the Council of Mortgage Lenders or Building Society Association websites. Very few lenders make their panel listings available online.
I have today made my last payment due on mortgage with Whistletree. I assume I don't need a solicitor on the Whistletree panel to remove the mortgage at the Land Registry. Am I right?
If you have finished paying off your Whistletree mortgage they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Whistletree mortgage from the register. Whistletree,and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage: but are not moving to another property where the Whistletree has sent the Land Registry the discharge electronically, and the Whistletree has instructed the Land Registry to do so The Land Registry will send you a letter confirming that your Whistletree mortgage has been paid off.
I am due to exchange contracts on my house. I had a double glazing fitted in month 6 but did not receive a FENSA certificate or Building Regulation Certificate. My buyer's lender, Whistletree are being a right pain. The solicitor who is on the Whistletree conveyancing panel is saying indemnity insurance will be fine but Whistletree are requiring a building regulation certificate. Why do Whistletree have a conveyancing panel of they don’t accept advice from them?
It is probably the case that Whistletree have referred the matter to their valuer. The reason why Whistletree may not want to accept indemnity insurance is because it does not give them any reassurance that the double glazing correctly and safely installed. It merely protects against enforcement action which is very unlikely anyway.
