Q and A’s regarding the Cynergy Bank Solicitor Panel
My fiance and I are FTBs. Within the last couple of days our lawyer has sent a preliminary report and documents to look through with the expectation that exchange is imminent. Cynergy Bank have this morning contacted us to advise us that they have now hit a problem as our solicitor is not on their conveyancing panel. Is this a problem?
If you are buying a property with the assistance of a mortgage it is usual for the purchaser's solicitors to also act for the purchaser's lender.
In order to act for a bank or building society a law firm has to be on that lender's conveyancing panel. An application has to be made by the law firm to the lender to become a member of the lender's panel and there are increasingly strict criteria which the firm has to satisfy and indeed some lenders now require their panel members to be part of the Law Society’s Conveyancing Quality Scheme.
Your property lawyers should contact Cynergy Bank and see if they can apply for membership of the Cynergy Bank conveyancing panel, but if that is not viable Cynergy Bank will instruct their own solicitors to act. You don't have to instruct a firm on the Cynergy Bank conveyancing panel as you are at liberty to use your preferred lawyers, in which case your legal fees may increase, and it may delay matters as you are adding another lawyer into the mix.
I do hope you can help me. My lawyer is informing me me that she is duty-bound to conduct a Local Authority search stemming from the fact that the firm are on the Cynergy Bank solicitor panel. Is this really necessary?
You have limited options available to you. Given that you are taking out a loan with Cynergy Bank your lawyer has to comply with their conditions as set out in their version of the CML Conveyancing Handbook. Your lawyer would have previously signed the Terms and Conditions of Cynergy Bank’s conveyancing panel appointment which obliges them to follow the CML Handbook requirements last updated Cynergy Bank. even if you were a cash buyer you would be ill advised not to carry out a local authority search.

As your lender is Cynergy Bank your lawyer must to check the Cynergy Bank conveyancing instructions contained in the Part of CML Handbook for Cynergy Bank . The CML Handbook contains minimum requirements for solar panel roof-space leases, and solicitors are required to report to Cynergy Bank where a lease does not meet these requirements. The requirements relate to the installation of panels on properties in England and Wales. The CML are developing guidance for Northern Ireland and Scotland.
I have paid off my mortgage with Cynergy Bank. I assume I don't need a solicitor on the Cynergy Bank panel to remove the mortgage at the Land Registry. Please confirm
If you have finished paying off your Cynergy Bank mortgage they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Cynergy Bank mortgage from the register. Cynergy Bank,and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage:

the Cynergy Bank has instructed the Land Registry to do so
The Land Registry will send you a letter confirming that your Cynergy Bank mortgage has been paid off.
I recently had an offer accepted on a house. My financial adviser suggested a solicitor I paid an upfront payment of 150. Soon after the conveyancers contacted me to say that they were not on the Cynergy Bank conveyancing panel. Am I right in thinking that I should be due a refund?
You should be able to recover this from the law firm if they were not on the Cynergy Bank panel. They should have asked at the outset which lender you were obtaining a mortgage with. An important lesson to readers of this site is to check that the lawyers are on the appropriate lender panel.
