Cynergy Bank conveyancing requirements for their panel are no better or no more complicated than most lenders.
It is the case now the CML Handbook, the "bible" used by solicitors to establish lender requirements, is different for each lender.
It is not clear if your lawyer is on the Cynergy Bank conveyancing panel. If they are not, this does add further risk of delay as Cynergy Bank will appoint their own solicitors to look after their interest.
Our lawyer has discovered a defect with the lease for the property we are buying. The seller’s lawyers have offered defective title insurance as a solution. Just because you have a mortgage offer from Cynergy Bank does not mean to say that the property will be meet their requirements for the purposes of a mortgage. Your lawyer has to ensure that the lease has to comply with the CML Handbook Requirements. You and Cynergy Bank are the client. These conveyancing instructions must be adhered to by the Cynergy Bank conveyancing panel who has to balance acting for you and Cynergy Bank
Having used your search tool I can't find the lawyer I was hoping to instruct as being on the Cynergy Bank conveyancing panel. My lawyer has said that they are on the Cynergy Bank approved panel. How can I be sure given that they are not listed on your directory?
Not all firms are yet listed on our lender panel search tool which is still relatively new. Law firms are listing on a daily basis and it is probably the case that your lawyer is on the Cynergy Bank conveyancing lawyer and you should probably take them at their word. Please do feel free to suggest that they completing their listing on our site as it would only cost them £1 a month to list themselves as being on the Cynergy Bank solicitor panel.
The lawyers that I appointed last week on my purchase in London has suddenly shut down. I chose them because I needed a lawyer on the Cynergy Bank conveyancing panel and my previous lawyer was not. I paid them £200 on account. What should be my next steps?
If you have an estate agent involved then inform them straight away so that they can let the sellers know that there may be a slight delay due to reasons beyond your control. Most sellers would be sympathetic and urge their lawyer to send a new set of papers to your new solicitors. You should appoint new lawyers that are on the Cynergy Bank conveyancing panel and notify the lender. If you have paid over any money it will hopefully be held by the SRA as money in an intervened firm's bank accounts is transferred to the SRA. Then, the SRA or the intervention agent looks at the intervened firm's accounts to work out who the money belongs to. To claim your money you will need to contact the SRA. If the SRA cannot return money you are owed from the firm's bank accounts, or if they can only return part of the money, you can apply to the Compensation Fund for a grant. Your new solicitors should be in a position to help
Is the case that all CQS (Conveyancing Quality Scheme) solicitors on the Cynergy Bank conveyancing panel?
Some major banks and building societies now use CQS as the starting point for Panel membership such as HSBC and Santander. CQS membership however is no guarantee to lender panel acceptance. That being said,the Council of Mortgage Lenders have indicated that it is likely to become a pre-requisite for firms wishing to join their approved list of conveyancing solicitors.
Are all conveyancing solicitors on the Cynergy Bank conveyancing panel overseen by the SRA?
As solicitors, in order to be on the Cynergy Bank conveyancing panel they would need to be regulated by the SRA. Many lenders do allow licenced conveyancers on their panel in which case such firms would be regulated by the Council of Licensed Conveyancers (CLC).
I have paid off my mortgage with Cynergy Bank. I assume I don't need a solicitor on the Cynergy Bank panel to remove the mortgage at the Land Registry. Am I right?
If you have finished paying off your Cynergy Bank mortgage they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Cynergy Bank mortgage from the register. Cynergy Bank,and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage:
but are not moving to another property
where the Cynergy Bank has sent the Land Registry the discharge electronically, and
the Cynergy Bank has instructed the Land Registry to do so
The Land Registry will send you a letter confirming that your Cynergy Bank mortgage has been paid off.
