  • What happens if my solicitor is removed from the Handelsbanken Conveyancing panel before the completion date?
    First, this is very unlikely to happen. In most cases even where a law firm is removed off of a panel the lender would allow the completion to go ahead as the lender would appreciate the difficulties that they would place you in if you have ti instruct a new solicitor days before completion. The analogous situation is where a buyer instructs a lawyer, exchanges contracts and the law firm is shut down by the regulator such as the SRA. Again, in this situation you can find lawyers who can troubleshoot their way to bring the conveyancing to a satisfactory conclusion - albeit at a cost.
  • My conveyancers in London have advised me that no longer have my conveyancing file. At the time of my purchase I took out a mortgage with Handelsbanken. Is it case that being on the Handelsbanken conveyancing panel they need to have retained the file for a number of years?
    It very much depends from lender to lender but many of the Terms and Conditions of Conveyancing Panel Appointment require the file to be held for a period of 6 years.     You can use any solicitor you like but Handelsbanken then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the Handelsbanken solicitors panel
  • I was scheduled to complete on my first house yesterday. My solicitor is on the Handelsbanken conveyancing panel but has changed address in the past couple of months and had not advised Handelsbanken of their new address. Handelsbanken is now refusing to release my funds as the information from the solicitors isn't correct.
    This is a rare situation indeed. The majority of lender Terms of Conveyancing Panel Appointment specifically oblige the solicitor to inform the lender of an address change. Your solicitor needs to treat this with the utmost urgency. Do speak with or register your concern with the senior partner (assuming he or she is not your direct lawyer). Most lenders would be reasonable in this situation and expedite the resolution of this issue. It may be prudent to enlist the help of your local Handelsbanken branch or your mortgage broker to see if they can assist.
  • The firm that just started acting on my purchase in London has suddenly closed. They were on acting for me because I needed a firm on the Handelsbanken conveyancing panel and my previous lawyer was not. I paid them £200 on account. What do I do now?
    If you have an estate agent involved then let them know straight away so that they can let the sellers know that there may be a slight delay due to reasons beyond your control. Hopefully they will be sympathetic and urge their lawyer to send a new set of papers to your new solicitors.     As you are obtaining a mortgage with Handelsbanken your lawyer must to check the Handelsbanken conveyancing instructions contained in the Part 2 of the UK Finance Mortgage Lenders' Handbook for Handelsbanken. The UK Finance Mortgage Lenders' Handbook contains minimum requirements for solar panel roof-space leases, and solicitors are required to report to Handelsbanken where a lease does not meet these requirements. The requirements relate to the installation of panels on properties in England and Wales. UK Finance are developing guidance for Northern Ireland and Scotland.

    Although you do need to retain the services of a lawyer they dont need to be on the Handelsbanken panel. You will need a solicitor to draw up the transfer and to deal with the Land Registry formalities. The only thing you need to consider is that by selling at an undervalue so ask your lawyer about the implications. There could be an inheritance tax issue if you die within 7 years of this. There's no capital gains tax for you as it is your main residence.

    Handelsbanken must be informed of your intention before renting your property as this is likely to be a breach of Handelsbanken's mortgage conditions. In many cases banks or building societies will allow you to rent out your former home without needing to switch to a buy-to-let mortgage but some lenders will add a surcharge to your mortgage rate to reflect the higher risk. You should contact Handelsbanken directly. It should not be necessary to do this via a Handelsbanken conveyancing panel solicitor.
  • Can I register a complaint to Handelsbanken about the lawyers being on the Handelsbanken conveyancing panel?
    There is little point in complaining directly to Handelsbanken. All solicitors and conveyancer must have a complaints procedure. You can get information from the solicitor's or conveyancer's website or ask at their office. They must tell you about it if you ask.

    The Legal Ombudsman will make sure that your complaint is properly dealt with by the solicitor. It can also advise you how to complain.

    If a licensed conveyancer does not have a complaints procedure or will not tell you about it, contact the Council for Licensed Conveyancers (CLC), which will make sure that your complaint is properly dealt with by the conveyancer. Please see below for more information.

  • It is not clear whether my mortgage offer requires a lease extension. I have telephoned Handelsbanken on numerous occasions and told it wasn't a problem and they would lend. My solicitor - who is on the Handelsbanken conveyancing panel- telephoned and was told not they would not lend in accordance with their UK Finance Mortgage Lenders' Handbook minimum lease term requirements. Who do I believe?
    As long as the conveyancer is on the Handelsbanken panel she or he must comply with the UK Finance Mortgage Lenders' Handbook requirements for Handelsbanken. Unless your lawyer obtains specific confirmation in writing that Handelsbanken will go ahead your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask Handelsbanken to contact your lawyer in writing confirming that they will accept the remaining number of years left on the lease.
  • I recently had an offer accepted on a house. My mortgage broker recommended their conveyancers I paid an upfront payment of 175. Soon after the conveyancers contacted me to say that they were not on the Handelsbanken conveyancing panel. Am I right in thinking that I should be due a refund?
    You should be able to recover this from the law firm if they were not on the Handelsbanken panel. They should have asked at the outset which lender you were obtaining a mortgage with. An important lesson to readers of this site is to check that the lawyers are on the appropriate lender panel.
  • I am selling my house. I had a double glazing fitted in month 2010 but did not receive a FENSA certificate or Building Regulation Certificate. My buyer's mortgage company, Handelsbanken are being a right pain. The solicitor who is on the Handelsbanken conveyancing panel is saying indemnity insurance will be fine but Handelsbanken are insisting on a building regulation certificate. Why do Handelsbanken have a conveyancing panel of they don’t accept advice from them?
    It is probably the case that Handelsbanken have referred the matter to their valuer. The reason why Handelsbanken may not want to accept indemnity insurance is because it does not give them any reassurance that the double glazing correctly and safely installed. It merely protects against enforcement action which is very unlikely anyway.
  • Intending to buy a flat with a mortgage with Handelsbanken. I have received an online quote from a licensed conveyancer, which states: "There will be no charge for dealing with the Building Society if you are obtaining a mortgage". I take this to mean that there will be no additional fee if the solicitor is on the Handelsbanken conveyancing panel. I wanted to make sure it means there will be no additional fees for dealing with the mortgage.
    They are simply saying that the cost for acting for the lender is included in the fee being quoted. It is worth you checking that they are on the Handelsbanken conveyancing panel
  • My ex -wife's name is on the Handelsbanken mortgage of my property but not on the land registry. The apartment was transferred to me on our divorce many years ago by way of a sealed court order. Does my ex still have a say on the sale even though the land registry showing the property in my name alone? Will I be required to take her name of the Handelsbanken mortgage in order to sell?
    In terms of the Handelsbanken mortgage, it is unusual that your ex-wife's name remains on the mortgage but not on the title. It is conceivable that this is an oversight on the part of your conveyancers to ensure that her name was removed or even an administrative error on the part of Handelsbanken in failing to update their data. In any event, it should cause difficulty providing her name no longer appears on the Land Registry title and you have a court order ordering that the property is transferred to you.

    Unfortunately both you and your lawyer have little choice here. As you are taking a mortgage with Handelsbanken your lawyer has to comply with their conditions as set out in their version of the UK Finance Mortgage Lenders' Handbook. Your lawyer would have previously signed the Terms and Conditions of Handelsbanken's conveyancing panel appointment which obliges them to follow the UK Finance Mortgage Lenders' Handbook requirements last updated Handelsbanken. even if you were a cash buyer you would be ill advised not to carry out a local authority search.
  • Our lawyer has identified a defect with the lease for the property we are buying. The other side have suggested title insurance as a solution. We are happy with insurance and will pay for it.     The short answer to your last question is that, notwithstanding the potential for a conflict of interest, you and Handelsbanken are the client. A precondition to being on the Handelsbanken approved panel is to comply with the UK Finance Mortgage Lenders' Handbook requirements (last updated for this lender on Handelsbanken).   • My wife and I are refinancing our apartment with Handelsbanken. We have a son 19 who lives with us. The solicitor on the Handelsbanken conveyancing panel requested us to identify any adults other than ourselves who reside at the property. The solicitor has now sent a form for our son to sign, giving up any rights in the event that the flat is repossessed. I have two questions (1) Is this form unique to the Handelsbanken conveyancing panel as he never had to sign this form when we purchased 3 years ago (2) Does our son by signing this giving up his rights to inherit the property?
    First, rest assured that your Handelsbanken conveyancing panel solicitor is doing the right thing as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to Handelsbanken.This is solely used to protect the Handelsbanken if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave.

    It does not impact your son's right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of Handelsbanken had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.

    The best course of action for you to take is to contact your lawyer directly. It is reasonable to expect your lawyer to advise you of the situation. If they are not on the panel they may recommend you to a firm that is on the conveyancing panel for Handelsbanken.
  • I am selling my flat and the EA has just called to say that the buyers are changing their conveyancer. The reason given is that Handelsbanken will only deal with solicitors on their conveyancing panel. Why would a big named lender only deal with certain solicitors?
    Lenders have always had panels of law firms they are willing to work with, but in the past few years big names such as Santander, have reviewed and reduced their conveyancing panel– in some cases removing conveyancing firms who have worked with them for more than 25 years.

    Lenders blame a rise in fraud as the reason for the cull – criteria have been tightened and a smaller panel should be easier to keep an eye on. No lender will say how many solicitors have been dropped, claiming the information is commercially sensitive, but the Law Society says it is hearing daily from firms that have been removed from panels, or have other concerns about them. Some do not even realise they have been dropped until contacted by a borrower who has instructed them as might be the situation in your buyer's case. Your purchasers are unlikely to have any sway in the decision.

  • I am getting a mortgage with Handelsbanken. I intend to use a Licensed Conveyancer. Does the Handelsbanken Conveyancing panel include Licensed Conveyancers
    Handelsbanken's conveyancing panel is, like many other lenders associated to the Council or Mortgage Lenders or BSA, open to Licensed Conveyancers regulated by the CLC.

    No, not really. The mortgage offered to you is subject to its terms and conditions, one of which will be that lawyers will on the Handelsbanken conveyancing panel. Until recently, most lenders had large numbers of law firms on their panels: a borrower could choose one for themselves, as long as it was on the lender's panel. The lender would then simply instruct the borrower's lawyers to act for the lender, too. You can use your lender's panel lawyers or you could borrow from another lender which does not restrict your choice. Another option that might be available is for your lawyer to apply to be on the conveyancing panel for Handelsbanken
