    The form is intended to provide information to the main parties involved in the transaction. Therefore, it will be provided to your son's lawyer who should be on the New Street Mortgages conveyancing panel as a standard part of the process, and to the valuer when requested.

    The Developer will be required to start the process by downloading the form and completing it.

    The form will therefore need to be available for the valuer at the time of his or her site visit. The form should be sent to the New Street Mortgages conveyancing panel solicitor as early as possible, in order to avoid any last minute delays, and no later than at exchange of contracts.

Most lenders would be reasonable in this situation and expedite the resolution of this issue.     3. Urge your lawyer to apply to join the New Street Mortgages lender panel
  • I am selling my flat and the EA has just called to say that the buyers are changing their conveyancer. The reason given is that New Street Mortgages will only deal with solicitors on their conveyancing panel. Why would a big named lender only deal with certain solicitors?
    Lenders have always had panels of law firms they are willing to work with, but in the past few years big names such as Santander, have reviewed and reduced their conveyancing panel– in some cases removing conveyancing firms who have worked with them for more than 25 years.

    Lenders blame a rise in fraud as the reason for the cull – criteria have been tightened and a smaller panel should be easier to keep an eye on. No lender will say how many solicitors have been dropped, claiming the information is commercially sensitive, but the Law Society says it is hearing daily from firms that have been removed from panels, or have other concerns about them. Some do not even realise they have been dropped until contacted by a borrower who has instructed them as might be the situation in your buyer's case. Your purchasers are unlikely to have any sway in the decision.

  • Is the fact that my solicitor is not on the New Street Mortgages Conveyancing panel that there is a problem with the standard of his work?
    That would more than likely be a wrong assumption to make. There are all sorts of perfectly reasonable explanations.     No, not really. The mortgage offered to you is subject to its terms and conditions, one of which will be that lawyers will on the New Street Mortgages conveyancing panel. Until recently, most lenders had large numbers of law firms on their panels: a borrower could choose one for themselves, as long as it was on the lender's panel. The lender would then simply instruct the borrower's lawyers to act for the lender, too. You can use your lender's panel lawyers or you could borrow from another lender which does not restrict your choice. Another option that might be available is for your lawyer to apply to be on the conveyancing panel for New Street Mortgages

    In order to act for a bank or building society a law firm has to be on that lender's conveyancing panel. An application has to be made by the law firm to the lender to become a member of the lender's panel and there are increasingly strict criteria which the firm has to satisfy and indeed some lenders now require their panel members to be part of the Law Society's Conveyancing Quality Scheme. Your solicitors should contact New Street Mortgages and see if they can apply for membership of the New Street Mortgages conveyancing panel, but if that is not viable New Street Mortgages will instruct their own solicitors to act. You don't have to instruct a firm on the New Street Mortgages conveyancing panel and you may continue to use your own solicitors, in which case it will likely add costs, and it may delay matters as you have another set of people involved.

The only thing you need to consider is that by selling at an undervalue so ask your lawyer about the implications. There could be an inheritance tax issue if you die within 7 years of this. There's no capital gains tax for you as it is your main residence.
  • I am currently in the process of buying my council flat. I have a mortgage agreed with New Street Mortgages. Conveyancing is new to me. Can I proceed without a solicitor easily? I think we can but we keep being told I should use one. Any advice?
    It is not advisable proceed with a house purchase without a solicitor. The council's solicitor are not acting for you. You need a solicitor for a number reasons. One of which is to verify what plans the Council have for repairs and refurbishment for the next five years. Many leaseholders have been stung for contributions of thousands of pounds. In any event if you are getting a mortgage with New Street Mortgages you will need to appoint a solicitor on the New Street Mortgages conveyancing panel.
  • The for formalities of my purchase has taken place with a mortgage from New Street Mortgages. Conveyancing was satisfactory but I would like to complain about New Street Mortgages. How do I make a complaint?
    All banks and building societies have complaints procedures. Your first point of contact should be one of the New Street Mortgages branches or the Customer Services Department at New Street Mortgages head office. We understand that complaints to New Street Mortgages are sorted out very quickly. If you feel that the matter is not resolved you can write to the Financial Ombudsman Service at South Quay Plaza, 183 Marsh Wall, London E14 9SR with full details of your complaint.
  • Can I register a complaint to New Street Mortgages about the lawyers being on the New Street Mortgages conveyancing panel?
    There is little point in complaining directly to New Street Mortgages. All solicitors and conveyancer must have a complaints procedure. You can get information from the solicitor's or conveyancer's website or ask at their office. They must tell you about it if you ask.

    The Legal Ombudsman will make sure that your complaint is properly dealt with by the solicitor. It can also advise you how to complain.

  • I recently had an offer accepted on a house. My mortgage broker recommended their conveyancers I paid an upfront payment of 175. Soon after the conveyancers contacted me to say that they were not on the New Street Mortgages conveyancing panel. Am I right in thinking that I should be due a refund?
    You should be able to recover this from the law firm if they were not on the New Street Mortgages panel. They should have asked at the outset which lender you were obtaining a mortgage with. An important lesson to readers of this site is to check that the lawyers are on the appropriate lender panel.
  • I am selling my house. I had a double glazing fitted in month 2010 but did not receive a FENSA certificate or Building Regulation Certificate. My buyer's mortgage company, New Street Mortgages are being a right pain. The solicitor who is on the New Street Mortgages conveyancing panel is saying indemnity insurance will be fine but New Street Mortgages are insisting on a building regulation certificate. Why do New Street Mortgages have a conveyancing panel of they don’t accept advice from them?
    It is probably the case that New Street Mortgages have referred the matter to their valuer. The reason why New Street Mortgages may not want to accept indemnity insurance is because it does not give them any reassurance that the double glazing correctly and safely installed. It merely protects against enforcement action which is very unlikely anyway.
  • Intending to buy a flat with a mortgage with New Street Mortgages. I have received an online quote from a licensed conveyancer, which states: "There will be no charge for dealing with the Building Society if you are obtaining a mortgage". I take this to mean that there will be no additional fee if the solicitor is on the New Street Mortgages conveyancing panel. I wanted to make sure it means there will be no additional fees for dealing with the mortgage.
    They are simply saying that the cost for acting for the lender is included in the fee being quoted. It is worth you checking that they are on the New Street Mortgages conveyancing panel
  • My ex -wife's name is on the New Street Mortgages mortgage of my property but not on the land registry. The apartment was transferred to me on our divorce many years ago by way of a sealed court order. Does my ex still have a say on the sale even though the land registry showing the property in my name alone? Will I be required to take her name of the New Street Mortgages mortgage in order to sell?
    In terms of the New Street Mortgages mortgage, it is unusual that your ex-wife's name remains on the mortgage but not on the title. It is conceivable that this is an oversight on the part of your conveyancers to ensure that her name was removed or even an administrative error on the part of New Street Mortgages in failing to update their data. In any event, it should cause difficulty providing her name no longer appears on the Land Registry title and you have a court order ordering that the property is transferred to you.
