Find an Approved Solicitor on the Landbay Partners Ltd Conveyancing Panel

Common questions asked concerning the Landbay Partners Solicitor Panel

I would like to know the reason why all solicitors are not on the Landbay Partners Conveyancing panel?
Even though it may seem unfair for Landbay Partners to restrict who can act for them from the public’s or solicitor’s point of view, the other side of the coin is that the lenders are becoming ever more anxious and feel the necessary need to protect them from mortgage fraud and other illegal activities. As a result of this concern Landbay Partners are limiting their conveyancing panel to a size that they are happy to control. The Landbay Partners lawyer panel is not the most restricted
We are due to exchange on the purchase a house but as a result of damage from the recent storms I have agreed compensation from the seller of £3k approx by way of a reduction in the price. This was going to be dealt with as part of the conveyancing process but my mortgage company Landbay Partners will not agree to this. Why was Landbay Partners even consulted?
Your lawyer being on the Landbay Partners conveyancing panel is duty bound to inform Landbay Partners of any changes to the purchase price. If you were to refuse your lawyers to disclose the reduction to Landbay Partners then they would have to discontinue acting for you and Landbay Partners.
Do I have to have a meeting at the offices of the Landbay Partners conveyancing panel solicitor to execute the mortgage deed? If so, I will instruct a firm who offer conveyancing in Bristol so that I can attend their offices when needed.
As opposed to 12 years ago, most lenders no longer require their conveyancing panel solicitor to witness the borrowers signature. You will still be obliged to provide ID Documents and there are still distinct advantages to using a local solicitor, in your case a conveyancing solicitor in Bristol .
My solicitors in Birmingham have advised me that no longer have my conveyancing file. At the time of my purchase I took out a mortgage with Landbay Partners. Is it case that being on the Landbay Partners conveyancing panel they need to have retained the file for a number of years?
Different lenders have different requirements but many of the Terms and Conditions of Conveyancing Panel Appointment require the file to be held for a period of 6 years. That being said we have not seen a copy of the Landbay Partners Conveyancing Panel Terms. It might be worth you contacting Landbay Partners directly.
Do most lenders operate their own panel of solicitors?
Many lenders do operate a restricted conveyancing panel but a lot of lenders allow any solicitors to join their panel so long as they meet their criteria. Each lender sets their own criteria. For example the Landbay Partners conveyancing panel requirements are different to Landbay Partners’s conveyancing panel requirements.
I have paid off my mortgage with Landbay Partners. I assume I don't need a solicitor on the Landbay Partners panel to remove the mortgage at the Land Registry. Am I right?
If you have finished paying off your Landbay Partners mortgage they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Landbay Partners mortgage from the register. Landbay Partners, and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage: but are not moving to another property where the Landbay Partners has sent the Land Registry the discharge electronically, and the Landbay Partners has instructed the Land Registry to do so The Land Registry will send you a letter confirming that your Landbay Partners mortgage has been paid off.
My ex -wife’s name is on the Landbay Partners mortgage of my property but not on the land registry. The apartment was transferred to me on our divorce many years ago by way of a sealed court order. Does my ex still have a say on the sale even though the land registry showing the property in my name alone? Will I be required to take her name of the Landbay Partners mortgage in order to sell?
In terms of the Landbay Partners mortgage, it is unusual that your ex-wife’s name remains on the mortgage but not on the title. It is conceivable that this is an oversight on the part of your conveyancers to ensure that her name was removed or even an administrative error on the part of Landbay Partners in failing to update their data. In any event, it should cause difficulty providing her name no longer appears on the Land Registry title and you have a court order ordering that the property is transferred to you.
