That would more than likely be a wrong assumption to make. There are all sorts of perfectly reasonable explanations. The most common reasons for removal are: (1) lack of transactions (2) the lawyer is a sole practitioner (3) as part of the HSBC panel reduction (4) regulatory contact by SRA (5) accidental removal. If you are concerned you should simply call the firm and ask them why they are no longer on the approved list for Better HomeOwnership. On what basis would a law firm be removed from the Better HomeOwnership solicitor panel?

The solicitors assured me that they are on Better HomeOwnership conveyancing panel and gave me their panel number. Better HomeOwnership then told me that their panel number was dormant and would need to be reactivated. What do I do from here? Should I appoint a new solicitor currently on the approved panel for Better HomeOwnership?

Within the last couple of days our lawyer has sent a preliminary report and documents to look through with a view to exchanging next week. Better HomeOwnership have this morning contacted us to advise us that there is now an issue as our solicitor is not on their conveyancing panel. Is this a problem?
When purchasing a property with the benefit of a mortgage it is usual for the purchaser's solicitors to also act for the purchaser's lender. In order to act for a bank or building society a law firm has to be on that lender's conveyancing panel. An application has to be made by the law firm to the lender to become a member of the lender's panel and there are increasingly strict criteria which the firm has to satisfy and indeed some lenders now require their panel members to be part of the Law Society's Conveyancing Quality Scheme. Your solicitors should contact Better HomeOwnership and see if they can apply for membership of the Better HomeOwnership conveyancing panel, but if that is not viable Better HomeOwnership will instruct their own solicitors to act. You don't have to instruct a firm on the Better HomeOwnership conveyancing panel and you may continue to use your own solicitors, in which case it will likely add costs, and it may delay matters as you have another set of people involved.

First, this is very unlikely to happen. In most cases even where a law firm is removed off of a panel the lender would allow the completion to go ahead as the lender would appreciate the difficulties that they would place you in if you have ti instruct a new solicitor days before completion. In a worst case scenario where the lender insists that you instruct a new firm then it is possible for a very good lawyer to expedite the conveyancing albeit that you may pay a significant premium for this. The analogous situation is where a buyer instructs a lawyer, exchanges contracts and the law firm is shut down by the regulator such as the SRA. Again, in this situation you can find lawyers who can troubleshoot their way to bring the conveyancing to a satisfactory conclusion - albeit at a cost.I am selling my house. Does my lawyer arrange the survey of the property? Or I've read lots of house buying,I note that they all recommend that you should get your house surveyed prior to buying it. When I asked my solicitor - who is on the Better HomeOwnership conveyancing panel - on this she said they don't do this and I need to contract an independent surveyor. Is that normal?
Better HomeOwnership will need an independent valuation of the property. Your lawyer will not arrange this. Usually Better HomeOwnership will appoint their own surveyor to do this, and you will have to pay for it. Remember that this is a valuation for mortgage purposes and not a survey. You may wish to consider appointing your own surveyor to carry out a survey or prepare a home buyers report on the property. In terms of the Better HomeOwnership mortgage, it is unusual that your ex-wife's name remains on the mortgage but not on the title. It is conceivable that this is an oversight on the part of your conveyancers to ensure that her name was removed or even an administrative error on the part of Better HomeOwnership in failing to update their data. In any event, it should cause difficulty providing her name no longer appears on the Land Registry title and you have a court order ordering that the property is transferred to you.Better HomeOwnership have agreed my mortgage in principle, my offer on house has been accepted, now what?

My solicitor says that as she is on the Better HomeOwnership conveyancing panel she needs to redo the searches as they are now out of date.

I am now advised that as the deposit has not come from me my lawyer needs to disclose this to my lender Better HomeOwnership. Apparently, being on the Better HomeOwnership conveyancing panel and acting on their behalf he must inform Better HomeOwnership if the balance of the mortgage advance is not just from me. I informed the bank about my parent's contribution when I applied for the mortgage so is it really necessary for him to raise this?

We have a son 19 who lives with us. The solicitor on the Better HomeOwnership conveyancing panel requested us to identify any adults other than ourselves who reside at the property. The solicitor has now sent a form for our son to sign, giving up any rights in the event that the flat is repossessed. I have two questions (1) Is this form unique to the Better HomeOwnership conveyancing panel as he never had to sign this form when we purchased 3 years ago (2) Does our son by signing this giving up his rights to inherit the property?
First, rest assured that your Better HomeOwnership conveyancing panel solicitor is doing the right thing as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to Better HomeOwnership. This is solely used to protect the Better HomeOwnership if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave. It does not impact your son's right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of Better HomeOwnership had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.
We are due to exchange on the purchase a house but as a result of damage from the recent storms I have agreed compensation from the seller of £3k approx by way of a reduction in the price. This was going to be dealt with as part of the conveyancing process but my mortgage company Better HomeOwnership will not agree to this. Why was Better HomeOwnership even consulted?
Your lawyer being on the Better HomeOwnership conveyancing panel is duty bound to inform Better HomeOwnership of any changes to the purchase price. If you were to refuse your lawyers to disclose the reduction to Better HomeOwnership then they would have to discontinue acting for you and Better HomeOwnership. My son is buying a new build apartment with a mortgage from Better HomeOwnership. His lawyer has said that there is a delay in completing the 'Disclosure of Incentive Form'. Who needs to receive the form?

Therefore, it will be provided to your son's lawyer who should be on the Better HomeOwnership conveyancing panel as a standard part of the process, and to the valuer when requested. The Developer will be required to start the process by downloading the form and completing it.
The form will therefore need to be available for the valuer at the time of his or her site visit. The form should be sent to the Better HomeOwnership conveyancing panel solicitor as early as possible, in order to avoid any last minute delays, and no later than at exchange of contracts.
