My wife and I are FTBs. Within the last couple of days our property lawyer has forwarded the sale agreement to sign with a detailed report in anticipation of exchanging contracts shortly. Hinckley and Rugby have this morning contacted us to inform me that they have now hit a problem as our lawyer is not on their approved list of lawyers. Please explain?
If you are buying a property with the assistance of a mortgage it is usual for the purchaser's solicitors to also act for the purchaser's lender.

In order to act for a bank or building society a law firm has to be on that lender's conveyancing panel. An application has to be made by the law firm to the lender to become a member of the lender's panel and there are increasingly strict criteria which the firm has to satisfy and indeed some lenders now require their panel members to be part of the Law Society’s Conveyancing Accreditation Scheme. Your solicitors should contact Hinckley and Rugby and see if they can apply for membership of the Hinckley and Rugby conveyancing panel, but if that is not viable Hinckley and Rugby will instruct their own lawyers to represent them. You don't have to instruct a firm on the Hinckley and Rugby conveyancing panel as you are at liberty to use your preferred lawyers, in which case your legal fees may increase, and it may delay matters as you are adding another lawyer into the mix.

I am due to complete my purchase next Thursday. My conveyancing lawyer has asked me to provide him with a copy of the building insurance for the house as he says that he has to check this in has capacity as lawyer for Hinckley and Rugby. What does the insurance need to cover?
Any lawyer on the Hinckley and Rugby conveyancing panel would need to check that the following risks are covered fire; lightning; aircraft; explosion; earthquake; storm; flood; escape of water or oil; riot; malicious damage; theft or attempted theft; falling trees and branches and aerials; subsidence; heave;landslip;collision;accidental damage to underground services;professional fees, demolition and site clearance costs; and public liability to anyone else. You should speak to your lawyer directly before you start the process though to ensure that there is no problem as lenders are changing their requirements fairly frequently at the moment.
I had instructed online conveyancers located in Cardiff who are on the Hinckley and Rugby solicitor panel. They are now charging me a separate fee of £195 for dealing with the Hinckley and Rugby mortgage. Is this an additional conveyancing fee set by Hinckley and Rugby?
Unfortunately, as long as it is in their Terms and Conditions or Quote then yes your solicitors can charge a fee for this. This fee is not set by Hinckley and Rugby but by your lawyers. Some firms on the Hinckley and Rugby will charge an ‘acting for lender’ fee but plenty of firms include it on their overall fee.
Is it common for Hinckley and Rugby to withdraw a mortgage offer and what would be the reasoning?
Lenders such as Hinckley and Rugby can revoke their mortgage offer although this is unusual. should Hinckley and Rugby withdraw their offer they may or may not inform you or the lawyer as to their reasoning. There are various possible reasons but here are a number of examples:
  • If the borrower informs Hinckley and Rugby of a change in the loan amount agreed
  • Situations where information provided by the borrower that enabled the lender to make a lending decision is fraudulent, incorrect or misleading.
  • Following advice from the valuer on their lender panel or If the lender has doubts about the effectiveness of the valuation as a result of subsequent events or information received post valuation but pre completion
  • If the lender reasonably suspects that the applicant, borrower, mortgagor or guarantor is involved in any criminal or fraudulent activity, including trading in illegal drugs or other substances, theft, robbery, deception or other serious offences, or if the applicant borrower, mortgagor or guarantor has a conviction for any serious criminal offence, including theft, deception, fraud, robbery or trade in illegal drugs or other substances;
  • If the solicitor on the Hinckley and Rugby conveyancing panel acting for the applicant, borrower, mortgagor or guarantor cannot comply with Hinckley and Rugby ‘s instructions
I have a mortgage with Hinckley and Rugby. Conveyancing has been completed months ago. Should I wish to rent out the flat and do not currently have a buy-to-let mortgage do I need to remortgage to a buy-to-let mortgage or inform Hinckley and Rugby?
You must advise Hinckley and Rugby before renting your property as this is likely to be a breach of Hinckley and Rugby’s mortgage conditions. It may be that Hinckley and Rugby will allow you to rent out your former home without needing to switch to a buy-to-let mortgage but some lenders will add a surcharge to your mortgage rate to reflect the higher risk. You should contact Hinckley and Rugby directly. You need not do this via a Hinckley and Rugby conveyancing panel lawyer.
