Much to my surprise I have been told by my mortgage adviser that my the law firm I have appointed is not on the Hinckley and Rugby Solicitor panel. What can I do to check?
The best course of action for you to take is to contact your lawyer directly. It is reasonable to expect your lawyer to advise you what has happened. If they are not on the panel they could put your in touch with solicitors on the the approved Hinckley and Rugby solicitor panel.
I do hope you can help me. My lawyer is informing me me that he has to apply for a Local Authority search stemming from the fact that the firm are on the Hinckley and Rugby solicitor panel. Is this really necessary?
Unfortunately both you and your lawyer have little choice here. As you are taking a mortgage with Hinckley and Rugby your lawyer has to comply with their conditions as set out in their version of the CML Conveyancing Handbook. Your lawyer would have previously signed the Terms and Conditions of Hinckley and Rugby’s conveyancing panel appointment which obliges them to follow the CML Handbook requirements last updated Hinckley and Rugby. even if you were a cash buyer you would be ill advised not to carry out a local authority search.

You should speak to your lawyer directly before you start the process though to ensure that there is no problem as lenders are changing their requirements fairly frequently at the moment.

If you have finished paying off your Hinckley and Rugby mortgage they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Hinckley and Rugby mortgage from the register. Hinckley and Rugby,and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage:
but are not moving to another property

The Land Registry will send you a letter confirming that your Hinckley and Rugby mortgage has been paid off.
It is not clear whether my mortgage offer requires a lease extension . I have telephoned Hinckley and Rugby on numerous occasions and told it wasn't a problem and they would lend. My solicitor - who is on the Hinckley and Rugby conveyancing panel- telephoned and was told not they would not lend in accordance with their CML Handbook minimum lease term requirements. Your lawyer has to follow the CML Handbook Part 2 requirements for Hinckley and Rugby. Unless your lawyer obtains specific confirmation in writing that Hinckley and Rugby will go ahead your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask Hinckley and Rugby to contact your lawyer in writing confirming that they will accept the remaining number of years left on the lease.
