Unusual conveyancing
I am remortgaging my house does my lawyer have to be on the M&S Bank Conveyancing panel?
There is nothing to stop you using your solicitor but M&S Bank will insist on their interests being represented by a firm on their conveyancing panel. There is much more potential for delays and confusion with two solicitors involved, and it will undoubtedly be more expensive too.I am selling my house. Does my solicitor have to be on the M&S Bank conveyancing panel in order to deal with paying off my mortgage?
Ordinarily, even if your lawyer is not on the M&S Bank conveyancing panel they can still act for you on your sale. it might be that the lender will not release the original deeds (if applicable and increasingly irrelevant) until after the mortgage is paid off. You should speak to your lawyer directly before you start the process though to ensure that there is no problem as lenders are changing their requirements fairly frequently at the moment. My conveyancers in London have advised me that no longer have my conveyancing file. At the time of my purchase I took out a mortgage with M&S Bank. Is it case that being on the M&S Bank conveyancing panel they need to have retained the file for a number of years?
It very much depends from lender to lender but many of the Terms and Conditions of Conveyancing Panel Appointment require the file to be held for a period of 6 years. That being said we have not seen a copy of the M&S Bank Conveyancing Panel Terms. It might be worth you contacting M&S Bank directly.I was scheduled to complete on my first house yesterday. My solicitor is on the M&S Bank conveyancing panel but has changed address in the past couple of months and had not advised M&S Bank of their new address. M&S Bank is now refusing to release my funds as the information from the solicitors isn't correct.
This is a rare situation indeed. The majority of lender Terms of Conveyancing Panel Appointment specifically oblige the solicitor to inform the lender of an address change. Your solicitor needs to treat this with the utmost urgency. Do speak with or register your concern with the senior partner (assuming he or she is not your direct lawyer). Most lenders would be reasonable in this situation and expedite the resolution of this issue. They were on acting for me because I needed a firm on the M&S Bank conveyancing panel and my previous lawyer was not. I paid them £200 on account. What do I do now?
If you have an estate agent involved then let them know straight away so that they can let the sellers know that there may be a slight delay due to reasons beyond your control. Hopefully they will be sympathetic and urge their lawyer to send a new set of papers to your new solicitors. You will need to appoint new lawyers that are on the M&S Bank conveyancing panel and notify the lender. If you have paid over any money it will hopefully be held by the SRA as money in an intervened firm's bank accounts is transferred to the SRA. Then, the SRA or the intervention agent looks at the intervened firm's accounts to work out who the money belongs to. To claim your money you will need to contact the SRA. If the SRA cannot return money you are owed from the firm's bank accounts, or if they can only return part of the money, you can apply to the Compensation Fund for a grant. Your new lawyers may be able to assist

The solicitor on the M&S Bank conveyancing panel requested us to identify any adults other than ourselves who reside at the property. The solicitor has now sent a form for our son to sign, giving up any rights in the event that the flat is repossessed. I have two questions (1) Is this form unique to the M&S Bank conveyancing panel as he never had to sign this form when we purchased 3 years ago (2) Does our son by signing this giving up his rights to inherit the property?
First, rest assured that your M&S Bank conveyancing panel solicitor is doing the right thing as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to M&S Bank. This is solely used to protect the M&S Bank if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave. It does not impact your son's right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of M&S Bank had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.
My son is buying a new build apartment with a mortgage from M&S Bank. His lawyer has said that there is a delay in completing the 'Disclosure of Incentive Form'. Who needs to receive the form?

Therefore, it will be provided to your son's lawyer who should be on the M&S Bank conveyancing panel as a standard part of the process, and to the valuer when requested. The Developer will be required to start the process by downloading the form and completing it.
The form will therefore need to be available for the valuer at the time of his or her site visit. The form should be sent to the M&S Bank conveyancing panel solicitor as early as possible, in order to avoid any last minute delays, and no later than at exchange of contracts.

M&S Bank and other lenders normally restrict either the type or the number of conveyancing firms on their panel.
