    Unfortunately, as long as it is in their Terms and Conditions or Quote then yes your solicitors can charge a fee for this. This fee is not set by Precise Mortgages but by your lawyers. Some firms on the Precise Mortgages will charge an 'acting for lender' fee and others do not.

The UK Finance Mortgage Lenders' Handbook contains minimum requirements for solar panel roof-space leases, and solicitors are required to report to Precise Mortgages where a lease does not meet these requirements. The requirements relate to the installation of panels on properties in England and Wales. UK Finance are developing guidance for Northern Ireland and Scotland.

We would not encourage you to both use the same solicitors' firm. There are clear conflict of interest issues and it's not going to make a huge difference to the speed of the overall process. So as not to hold things us you should pass on your solicitors details to Precise Mortgages.     If you have finished paying off your Precise Mortgages mortgage they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Precise Mortgages mortgage from the register. Precise Mortgages,and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage: but are not moving to another property where the Precise Mortgages has sent the Land Registry the discharge electronically, and the Precise Mortgages has instructed the Land Registry to do so The Land Registry will send you a letter confirming that your Precise Mortgages mortgage has been paid off.

    Precise Mortgages must be informed of your intention before renting your property as this is likely to be a breach of Precise Mortgages's mortgage conditions. In many cases banks or building societies will allow you to rent out your former home without needing to switch to a buy-to-let mortgage but some lenders will add a surcharge to your mortgage rate to reflect the higher risk. You should contact Precise Mortgages directly. It should not be necessary to do this via a Precise Mortgages conveyancing panel solicitor.
  • The for formalities of my purchase has taken place with a mortgage from Precise Mortgages. Conveyancing was satisfactory but I would like to complain about Precise Mortgages. How do I make a complaint?
    All banks and building societies have complaints procedures. Your first point of contact should be one of the Precise Mortgages branches or the Customer Services Department at Precise Mortgages head office. We understand that complaints to Precise Mortgages are sorted out very quickly. Unless your lawyer obtains specific confirmation in writing that Precise Mortgages will go ahead your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask Precise Mortgages to contact your lawyer in writing confirming that they will accept the remaining number of years left on the lease.
  • I am selling my house. I had a double glazing fitted in month 2010 but did not receive a FENSA certificate or Building Regulation Certificate. My buyer's mortgage company, Precise Mortgages are being a right pain. The solicitor who is on the Precise Mortgages conveyancing panel is saying indemnity insurance will be fine but Precise Mortgages are insisting on a building regulation certificate. Why do Precise Mortgages have a conveyancing panel of they don’t accept advice from them?
    It is probably the case that Precise Mortgages have referred the matter to their valuer. The reason why Precise Mortgages may not want to accept indemnity insurance is because it does not give them any reassurance that the double glazing correctly and safely installed. It merely protects against enforcement action which is very unlikely anyway.
  • Intending to buy a flat with a mortgage with Precise Mortgages. I have received an online quote from a licensed conveyancer, which states: "There will be no charge for dealing with the Building Society if you are obtaining a mortgage". I take this to mean that there will be no additional fee if the solicitor is on the Precise Mortgages conveyancing panel. I wanted to make sure it means there will be no additional fees for dealing with the mortgage.
    They are simply saying that the cost for acting for the lender is included in the fee being quoted. It is worth you checking that they are on the Precise Mortgages conveyancing panel

    The estate agent will want to know who your solicitors are (make sure these solicitors are on the lenders panel). Call up Precise Mortgages or your broker and complete any relevant paperwork. Precise Mortgages will tell you what documents they want. Precise Mortgages will instruct a valuer. The valuer will get in touch with the estate agent or seller to book an appointment. Once conducted (assuming no problems) it takes about week to get a mortgage offer. Precise Mortgages will issue the offer to you and your lawyer. The transaction will then take it's course according the nature and complexity of the conveyancing.

    The best course of action for you to take is to contact your lawyer directly. It is reasonable to expect your lawyer to advise you of the situation. If they are not on the panel they may recommend you to a firm that is on the conveyancing panel for Precise Mortgages.

    A survey recently commissioned by the Solicitors Regulatory Authority found that three quarters of law firms had been removed from a lender panel. The top reasons in order are:
    1. lack of transactions
    2. the lawyer is a sole practitioner
    3. as part of the HSBC panel reduction
    4. regulatory contact by SRA
    5. accidental removal. We are not aware of the specific or common criteria for removal by Precise Mortgages

    The answer depends on whether you still have confidence in the said solicitors and how long it will take for the firm to be reinstated on the Precise Mortgages conveyancing panel You may wish to enlist the help of your broker to check with the Precise Mortgages as to how long they think it will take to get the firm to get back on the panel.

    No, not really. The mortgage offered to you is subject to its terms and conditions, one of which will be that lawyers will on the Precise Mortgages conveyancing panel. Until recently, most lenders had large numbers of law firms on their panels: a borrower could choose one for themselves, as long as it was on the lender's panel. The lender would then simply instruct the borrower's lawyers to act for the lender, too. You can use your lender's panel lawyers or you could borrow from another lender which does not restrict your choice. Another option that might be available is for your lawyer to apply to be on the conveyancing panel for Precise Mortgages

UK Finance obligations

  • Our lawyer has identified a defect with the lease for the property we are buying. The other side have suggested title insurance as a solution. We are happy with insurance and will pay for it.     The short answer to your last question is that, notwithstanding the potential for a conflict of interest, you and Precise Mortgages are the client. A precondition to being on the Precise Mortgages approved panel is to comply with the UK Finance Mortgage Lenders' Handbook requirements (last updated for this lender on Precise Mortgages). The UK Finance Mortgage Lenders' Handbook conditions require your lawyer to disclose issues such as defects will the lease so that Precise Mortgages can be afforded the opportunity to check with their valuer as to the extent that the value of the property is affected. Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for you.
  • Can you clarify something for me?. For no fault of my lawyer but, my purchase conveyancing has been going on for months. The Local Authority Search from Precise Mortgages was dated random date and we have agreed a date for me to move into the property on 6 months + 3. My solicitor says that as she is on the Precise Mortgages conveyancing panel she needs to redo the searches as they are now out of date.
    One of the many conditions to being on the Precise Mortgages approved panel is to comply with the UK Finance Mortgage Lenders' Handbook requirements (last updated for this lender on Precise Mortgages)which states that a local authority search be not more than 6 months old. You should nevertheless ask your lawyer to check whether something called 'search validation' indemnity insurance is acceptable to Precise Mortgages.

    Your lawyer is obliged to check with Precise Mortgages to make sure that they are aware that the balance of the purchase price is not from your own funds. Your solicitor can only report this to Precise Mortgages if you agree, failing which, your lawyer must cease to continue acting.
  • My wife and I are refinancing our apartment with Precise Mortgages. We have a son 19 who lives with us. The solicitor on the Precise Mortgages conveyancing panel requested us to identify any adults other than ourselves who reside at the property. The solicitor has now sent a form for our son to sign, giving up any rights in the event that the flat is repossessed. I have two questions (1) Is this form unique to the Precise Mortgages conveyancing panel as he never had to sign this form when we purchased 3 years ago (2) Does our son by signing this giving up his rights to inherit the property?
    First, rest assured that your Precise Mortgages conveyancing panel solicitor is doing the right thing as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to Precise Mortgages.This is solely used to protect the Precise Mortgages if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave.

    It does not impact your son's right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of Precise Mortgages had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.

  • We are due to exchange on the purchase a house but as a result of damage from the recent storms I have agreed compensation from the seller of £3k approx by way of a reduction in the price. This was going to be dealt with as part of the conveyancing process but my mortgage company Precise Mortgages will not agree to this. Why was Precise Mortgages even consulted?
    Your lawyer being on the Precise Mortgages conveyancing panel is duty bound to inform Precise Mortgages of any changes to the purchase price. If you were to refuse your lawyers to disclose the reduction to Precise Mortgages then they would have to discontinue acting for you and Precise Mortgages.
  • My son is buying a new build apartment with a mortgage from Precise Mortgages. His lawyer has said that there is a delay in completing the 'Disclosure of Incentive Form'. Who needs to receive the form?
    The form is intended to provide information to the main parties involved in the transaction. Therefore, it will be provided to your son's lawyer who should be on the Precise Mortgages conveyancing panel as a standard part of the process, and to the valuer when requested.

    The Developer will be required to start the process by downloading the form and completing it.

    The form will therefore need to be available for the valuer at the time of his or her site visit. The form should be sent to the Precise Mortgages conveyancing panel solicitor as early as possible, in order to avoid any last minute delays, and no later than at exchange of contracts.

  • I am remortgaging my house does my lawyer have to be on the Precise Mortgages Conveyancing panel?
    There is nothing to stop you using your solicitor but Precise Mortgages will insist on their interests being represented by a firm on their conveyancing panel. There is much more potential for delays and confusion with two solicitors involved, and it will undoubtedly be more expensive too.
  • I am selling my house. Does my solicitor have to be on the Precise Mortgages conveyancing panel in order to deal with paying off my mortgage?
    Ordinarily, even if your lawyer is not on the Precise Mortgages conveyancing panel they can still act for you on your sale. it might be that the lender will not release the original deeds (if applicable and increasingly irrelevant) until after the mortgage is paid off. You should speak to your lawyer directly before you start the process though to ensure that there is no problem as lenders are changing their requirements fairly frequently at the moment.

    You can use any solicitor you like but Precise Mortgages then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the Precise Mortgages solicitors panel

This will help you to understand the registration process behind changing the details re the registered title. in your case it would appear that you are effectively purchasing the property from the estate. Your Precise Mortgages conveyancing panel solicitor pays the new mortgage money into the estate, the estate pays off the old mortgage, the charge is released and you become the owner and the Precise Mortgages mortgage is registered as a charge at the Land Registry.
