Who do I believe?
As long as the conveyancer is on the Swansea Building Society panel she or he must comply with the UK Finance Mortgage Lenders' Handbook requirements for Swansea Building Society. • My ex -wife's name is on the Swansea Building Society mortgage of my property but not on the land registry. The apartment was transferred to me on our divorce many years ago by way of a sealed court order. Does my ex still have a say on the sale even though the land registry showing the property in my name alone? Will I be required to take her name of the Swansea Building Society mortgage in order to sell?
In terms of the Swansea Building Society mortgage, it is unusual that your ex-wife's name remains on the mortgage but not on the title. It is conceivable that this is an oversight on the part of your conveyancers to ensure that her name was removed or even an administrative error on the part of Swansea Building Society in failing to update their data. In any event, it should cause difficulty providing her name no longer appears on the Land Registry title and you have a court order ordering that the property is transferred to you.
  • Swansea Building Society have agreed my mortgage in principle, my offer on house has been accepted, now what?
The estate agent will want to know who your solicitors are (make sure these solicitors are on the lenders panel). The valuer will get in touch with the estate agent or seller to book an appointment. Once conducted (assuming no problems) it takes about week to get a mortgage offer. Swansea Building Society will issue the offer to you and your lawyer. The transaction will then take it's course according the nature and complexity of the conveyancing.
  • My offer on house has been accepted, but there is a chain. The vendors have offered on somewhere, but not been accepted yet, and have viewings of other properties booked. My conveyancing solicitor has been instructed. What should be my next step? When should I get the mortgage app going with Swansea Building Society?
It is usual to have concerns where there is a chain as you are unlikely to want to be too out of pocket too early (mortgage application is approx £1k, then survey/valuation, conveyancing search costs, etc). First you should check that your solicitor is on the Swansea Building Society conveyancing panel. As to the next stages this very much depends on the circumstances of your case, desire for this property and on the state of the market. In a hot mortgage some buyers would pally for the mortgage with Swansea Building Society and pay for the valuation and only if it comes back ok would they pay their solicitor to press on with searches.

Your lawyer would have previously signed the Terms and Conditions of Swansea Building Society's conveyancing panel appointment which obliges them to follow the UK Finance Mortgage Lenders' Handbook requirements last updated Swansea Building Society. even if you were a cash buyer you would be ill advised not to carry out a local authority search.

My solicitor says that as he is on the Swansea Building Society conveyancing panel he must check that the lender is happy with this discrepancy and is still content to lend. Is my lawyer's stance right?

  • Can you clarify something for me?. For no fault of my lawyer but, my purchase conveyancing has been going on for months. The Local Authority Search from Swansea Building Society was dated random date and we have agreed a date for me to move into the property on 6 months + 3. My solicitor says that as she is on the Swansea Building Society conveyancing panel she needs to redo the searches as they are now out of date.

My conveyancing lawyer has asked me to provide him with a copy of the building insurance for the house as he says that he has to check this in has capacity as lawyer for Swansea Building Society. • We are nearing an exchange and my parents having sent the 10% deposit to my lawyer. I am now advised that as the deposit has not come from me my lawyer needs to disclose this to my lender Swansea Building Society. Apparently, being on the Swansea Building Society conveyancing panel and acting on their behalf he must inform Swansea Building Society if the balance of the mortgage advance is not just from me. I informed the bank about my parent's contribution when I applied for the mortgage so is it really necessary for him to raise this?
Your lawyer is obliged to check with Swansea Building Society to make sure that they are aware that the balance of the purchase price is not from your own funds. Your solicitor can only report this to Swansea Building Society if you agree, failing which, your lawyer must cease to continue acting.

Panel membership

  • Is there a reason why all solicitors are not on the Swansea Building Society Conveyancing panel?
Swansea Building Society and other lenders normally restrict either the type or the number of conveyancing firms on their panel. A common example of such restriction(s) being that a firm must have two or more partners. In addition to restricting the type of firm, some have decided to limit the number of firms they use to represent them. You should note that Swansea Building Society have no responsibility for the quality of advice provided by any member of Swansea Building Society Conveyancer Panel. Mortgage fraud was a key driver in the rationalisation of conveyancing panels a few years ago and whilst there are differing views about the extent of solicitor involvement in some of that fraud. Statistics from the Land Registry reveal that thousands of law firms only carry out one or two conveyances a year. Those supporting conveyancing panel cuts ask why law firms should have the right to be on a Lender panel when clearly, Conveyancing is not their speciality? To put it another way; would you want a conveyancing solicitor to represent you if you were charged with a crime; probably not.
  • I am selling my flat and the EA has just called to say that the buyers are changing their conveyancer. The reason given is that Swansea Building Society will only deal with solicitors on their conveyancing panel. Why would a big named lender only deal with certain solicitors?
Lenders have always had panels of law firms they are willing to work with, but in the past few years big names such as Santander, have reviewed and reduced their conveyancing panel– in some cases removing conveyancing firms who have worked with them for more than 25 years.

Lenders blame a rise in fraud as the reason for the cull – criteria have been tightened and a smaller panel should be easier to keep an eye on. No lender will say how many solicitors have been dropped, claiming the information is commercially sensitive, but the Law Society says it is hearing daily from firms that have been removed from panels, or have other concerns about them. Some do not even realise they have been dropped until contacted by a borrower who has instructed them as might be the situation in your buyer's case. Your purchasers are unlikely to have any sway in the decision.

  • My mortgage broker has asked me for my solicitor's panel member for the Swansea Building Society conveyancing panel. How do I find this out. I have tried my local Swansea Building Society branch but they don't know it.
You are best placed to get this information from your conveyancing lawyer. They should have a central record lender panel numbers including the Swansea Building Society panel reference.
  • I am getting a mortgage with Swansea Building Society. I intend to use a Licensed Conveyancer. Does the Swansea Building Society Conveyancing panel include Licensed Conveyancers
Swansea Building Society's conveyancing panel is, like many other lenders associated to the Council or Mortgage Lenders or BSA, open to Licensed Conveyancers regulated by the CLC.
  • On what basis would a law firm be removed from the Swansea Building Society solicitor panel?
A survey recently commissioned by the Solicitors Regulatory Authority found that three quarters of law firms had been removed from a lender panel. The top reasons in order are:
    1. lack of transactions
    2. the lawyer is a sole practitioner
    3. as part of the HSBC panel reduction
    4. regulatory contact by SRA
    5. accidental removal. We are not aware of the specific or common criteria for removal by Swansea Building Society
  • I instructed a firm of solicitors to work on my purchase 4 weeks ago having applied for a mortgage with Swansea Building Society. The solicitors assured me that they are on Swansea Building Society conveyancing panel and gave me their panel number. Swansea Building Society then told me that their panel number was dormant and would need to be reactivated. What do I do from here? Should I appoint a new solicitor currently on the approved panel for Swansea Building Society?
The answer depends on whether you still have confidence in the said solicitors and how long it will take for the firm to be reinstated on the Swansea Building Society conveyancing panel You may wish to enlist the help of your broker to check with the Swansea Building Society as to how long they think it will take to get the firm to get back on the panel.
  • My fiance and I are first time buyers. Within the last couple of days our lawyer has sent a preliminary report and documents to look through with a view to exchanging next week. Swansea Building Society have this morning contacted us to advise us that there is now an issue as our solicitor is not on their conveyancing panel. Is this a problem?
When purchasing a property with the benefit of a mortgage it is usual for the purchaser's solicitors to also act for the purchaser's lender.

In order to act for a bank or building society a law firm has to be on that lender's conveyancing panel. An application has to be made by the law firm to the lender to become a member of the lender's panel and there are increasingly strict criteria which the firm has to satisfy and indeed some lenders now require their panel members to be part of the Law Society's Conveyancing Quality Scheme. Your solicitors should contact Swansea Building Society and see if they can apply for membership of the Swansea Building Society conveyancing panel, but if that is not viable Swansea Building Society will instruct their own solicitors to act. You don't have to instruct a firm on the Swansea Building Society conveyancing panel and you may continue to use your own solicitors, in which case it will likely add costs, and it may delay matters as you have another set of people involved.

  • A solicitor I had intended to instruct on a remortgage said she would charge more if my lender is because of their difficult processes! Will I regret using Swansea Building Society? Any comments will be appreciated
Swansea Building Society conveyancing requirements for their panel are no better or no more complicated than most lenders. It is the case now the UK Finance Mortgage Lenders' Handbook, the "bible" used by solicitors to establish lender requirements, is different for each lender. It is not clear if your lawyer is on the Swansea Building Society conveyancing panel. If they are not, this does add further risk of delay as Swansea Building Society will appoint their own solicitors to look after their interest.

Unusual conveyancing

  • What happens if my solicitor is removed from the Swansea Building Society Conveyancing panel before the completion date?
First, this is very unlikely to happen. In most cases even where a law firm is removed off of a panel the lender would allow the completion to go ahead as the lender would appreciate the difficulties that they would place you in if you have ti instruct a new solicitor days before completion. In a worst case scenario where the lender insists that you instruct a new firm then it is possible for a very good lawyer to expedite the conveyancing albeit that you may pay a significant premium for this. The analogous situation is where a buyer instructs a lawyer, exchanges contracts and the law firm is shut down by the regulator such as the SRA. Again, in this situation you can find lawyers who can troubleshoot their way to bring the conveyancing to a satisfactory conclusion - albeit at a cost.
  • I am attempting to get my ex-husband taken off the mortgage deeds. Can Swansea Building Society really tell me which solicitor I can or can not use?
You can use any solicitor you like but Swansea Building Society then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the Swansea Building Society solicitors panel
  • We're in London, FTBs buying with a mortgage (lender is Swansea Building Society, but our solicitor is on the Swansea Building Society conveyancing panel). How long should the conveyancing process take?
The fact that your lawyer is on the Swansea Building Society conveyancing panel is a help. It would almost certainly delay matters if they were not. However, no conveyancer should guarantee a time-frame for your conveyancing due to third parties outside of our control such as delays caused by lenders, conveyancing search providers or by the other side's solicitors. The time taken is often determined by the number of parties in a chain
  • I was scheduled to complete on my first house yesterday. My solicitor is on the Swansea Building Society conveyancing panel but has changed address in the past couple of months and had not advised Swansea Building Society of their new address. Swansea Building Society is now refusing to release my funds as the information from the solicitors isn't correct.
This is a rare situation indeed. The majority of lender Terms of Conveyancing Panel Appointment specifically oblige the solicitor to inform the lender of an address change. Your solicitor needs to treat this with the utmost urgency. Do speak with or register your concern with the senior partner (assuming he or she is not your direct lawyer). Most lenders would be reasonable in this situation and expedite the resolution of this issue. It may be prudent to enlist the help of your local Swansea Building Society branch or your mortgage broker to see if they can assist.
  • The firm that just started acting on my purchase in London has suddenly closed. They were on acting for me because I needed a firm on the Swansea Building Society conveyancing panel and my previous lawyer was not. I paid them £200 on account. What do I do now?
If you have an estate agent involved then let them know straight away so that they can let the sellers know that there may be a slight delay due to reasons beyond your control. Hopefully they will be sympathetic and urge their lawyer to send a new set of papers to your new solicitors. You will need to appoint new lawyers that are on the Swansea Building Society conveyancing panel and notify the lender. If you have paid over any money it will hopefully be held by the SRA as money in an intervened firm's bank accounts is transferred to the SRA. Then, the SRA or the intervention agent looks at the intervened firm's accounts to work out who the money belongs to. To claim your money you will need to contact the SRA. If the SRA cannot return money you are owed from the firm's bank accounts, or if they can only return part of the money, you can apply to the Compensation Fund for a grant. Your new lawyers may be able to assist
  • My uncle passed away last year and as sole heir and executor was left the house. The house had a small mortgage left on it of around £8000. I want to transfer the title deeds into my name whilst I re-mortgage to Swansea Building Society, pay off the mortgage etc. Is this allowed?
If you intend to re-mortgage then Swansea Building Society will insist on your using a conveyancer on the Swansea Building Society conveyancing panel. Here is link to the Land Registry online guidance around what to do when a property owner dies. This will help you to understand the registration process behind changing the details re the registered title. in your case it would appear that you are effectively purchasing the property from the estate. Your Swansea Building Society conveyancing panel solicitor pays the new mortgage money into the estate, the estate pays off the old mortgage, the charge is released and you become the owner and the Swansea Building Society mortgage is registered as a charge at the Land Registry.
